JAKARTA – BERITATERKINI.co.id – Anggota Dewan Pengawas KPK, Syamsuddin Haris meminta agar pimpinan KPK yang rangkap jabatan segera mengundurkan diri.
“Iya sebaiknya tentu tidak (rangkap jabatan), karena bagaimanapun itu kan soal kesadaran saja,” kata Syamsudin di Gedung KPK, Jakarta Selatan, Senin (23/13/2019).
Namun demikian, ia mengaku jika sampai saat ini belum ada aturan pasti bahwa pimpinan yang rangkap jabatan harus mengundurkan diri.
Diketahui pimpinan KPK, Firli Bahuri masih menjabat struktural di Polri sebagai Analisis Kebijakan Utama Badan Pemelihara Keamanan Polri.
Sementara pimpinan KPK lainnya, Nawawi Pamolango sudah mengajukan pengunduran diri sebagai sebagai hakim di Pengadilan Tinggi Denpasar kepada Mahkamah Agung (MA).
Berdasarkan UU Nomor 19 Tahun 2019 Pasal 29 huruf i dijelaskan bahwa untuk dapat diangkat sebagai Pimpinan Komisi Pemberantasan Korupsi harus melepaskan jabatan struktural dan/atau jabatan lainnya selama menjadi anggota Komisi Pemberantasan Korupsi.
Sedangkan, Kapolri Idham Aziz menyatakan berdasarkan Pasal 29 UU nomor 30 tahun 2002 sebagaimana telah diubah dengan UU nomor 19 tahun 2019 tentang Komisi Pemberantasan Korupsi, seorang anggota Polri tidak harus mundur dari kesatuan, tetapi cukup melepaskan jabatan struktural di kepolisian.
