JAKARTA – BERITATERKINI.co.id – Terpidana kasus pembunuhan berencana, Jhon Kei mendapatkan pembebasan bersyarat dari Kementerian Hukum dan Hak Asasi Manusia (Kemenkumham) sejak Kamis, (26/12/2019).
Dengan demikian, Jhon Kei akan segera keluar dari Lapas Nusakambangan setelah masuk ke Lapas itu pada tahun 2014 lalu.
Bebas bersyarat tersebut berdasarkan surat keputusan Menteri Hukum dan HAM RI Nomor Pas-1502.PK.01.04.06 Tahun 2019 tertanggal 23 Desember 2019.
“Narapidana atas nama John Refra alias John Kei telah bebas menjalani pembebasan bersyarat pada tanggal 26 Desember 2019,” kata Kabag Humas dan Protokol Ditjen Pemasyarakatan Kemkumham, Ade Kusmanto dalam keterangannya di Jakarta, Kamis (26/12) malam.
Dia mengatakan, Jhon Kei sedianya baru bebas murni pada tanggal 31 Maret 2025 mendatang. Namun karena sudah memenuhi untuk mendapatkan bebas bersyarat, maka Jhon Kei bisa bebas pada Kamis, (26/12/2019). Sedangkan masa percobaan (pembebasan bersyarat) berakhir 31 Maret 2026.
Ade menyampaikan, pembebasan bersyarat merupakan hak narapidana sebagaimana diatur Pasal 14 ayat 1 (k) Undang-Undang No 12 Tahun 1995 tentang Pemasyarakatan.
Berdasarkan Permenkumham No 3 Tahun 2018, pembebasan bersyarat diberikan kepada narapidana yang telah memenuhi syarat. Pertama telah menjalani masa pidana paling sedikit 2/3 masa pidana dengan ketentuan paling sedikit 9 bulan.
“Berkelakuan baik 9 bulan terakhir terhitung dari 2/3 masa pidana dan telah mengikuti program pembinaan dengan baik,” terang Ade.
Sebelumnya, Majelis hakim Pengadilan Negeri Jakarta menjatuhkan vonis 12 tahun penjara kepada John Kei pada persidangan 27 Desember 2012 lalu. Majelis hakim menilai, John Kei terbukti melakukan pembunuhan berencana terhadap Tan Harry Tantono alias Ayung yang ditemukan tewas di kamar 2701 Swiss-Belhotel, Sawah Besar, Jakarta Pusat, pada 26 Januari 2012.
John Kei dinyatakan melanggar Pasal 340 juncto Pasal 55 Kitab Undang-Undang Hukum Pidana. Namun, setelah mengajukan banding, Hakim tingkat banding justru menambah vonis terhadap John Kei menjadi 16 tahun penjara. Setelah mendapat remisi 36 bulan 30 hari, berdasarkan perhitungan, John Kei akan bebas pada 31 maret 2025.
