JAKARTA – BERITATERKINI.co.id – Ketua KPK, Firli Bahuri memastikan bahwa Presiden Joko Widodo tidak pernah mengintervensi kinerja lembaga anti rasuah tersebut.
“Saya katakan bahwa presiden tidak pernah mengintervensi kinerja KPK termasuk dengan Dewan Pengawas. Presiden sangat jelas katakan bahwa presiden tidak pernah mengintervensi penegakan hukum oleh KPK,” ucap Firli di kantornya, Jalan Kuningan Persada, Jakarta Selatan, Senin (30/12/2019).
Sebelumnya, Wakil Ketua Umum Partai Gerindra, Fadli Zon mengatakan jika rawan konflik kepentingan jika pimpinan KPK bertanggung jawab kepada Presiden.
“Ya pasti akan ada conflict of interest karena langsung bertanggung jawab kepada presiden, kemudian nanti ada Dewan Pengawas juga yang ditunjuk oleh presiden. Saya kira ini mempunyai potensi tidak akan independen,” kata Fadli pada Jumat (27/12/2019) kemarin.
Kritik mengenai intervensi itu muncul setelah beredar draf Peraturan Presiden (Perpres) tentang Organisasi dan Tata Kerja Pimpinan dan Organ Pelaksana Pimpinan KPK. Dalam Pasal 1 pada draf itu disebut pimpinan KPK merupakan pejabat negara setingkat menteri yang berada di bawah dan bertanggung jawab kepada presiden sebagai kepala negara.
Berikut bunyi Pasal 1 di Perpres itu:
Pasal 1
(1) Pimpinan Komisi Pemberantasan Korupsi merupakan pejabat negara setingkat menteri yang berada di bawah dan bertanggung jawab kepada Presiden sebagai kepala negara.
(2) Pimpinan Komisi Pemberantasan Korupsi terdiri dari:
a. ketua merangkap anggota; dan
b. wakil ketua terdiri dari 4 (empat) orang, masing-masing merangkap anggota.
(3) Pimpinan Komisi Pemberantasan Korupsi sebagaimana dimaksud pada ayat (2) bersifat kolektif kolegial.
Selain perpres itu, sebenarnya Presiden Joko Widodo (Jokowi) menyiapkan 2 perpres lainnya terkait Dewan Pengawas KPK serta pegawai KPK sebagai Aparatur Sipil Negara, yang merupakan turunan dari Undang-Undang Nomor 19 Tahun 2019 yang merupakan UU baru KPK hasil revisi. Saat ini seluruh perpres itu masih berproses dan belum dinomori.
