Palembang, beritaterkini.co.id | Ketua Umum Lintas Aktivis Antar Generasi Indonesia Bung Sukma Hidayat, SE., yang didampingi oleh Tim Advokat Pos Bantuan Hukum (Posbakum) Lintas Aktivis Antar Generasi Indonesia (LAAGI) yakni Adv. Desmon Simanjuntak, S.H dan Adv. M. Ibrahim Adha, S.H, M.H, E.CIH., memenuhi panggilan Pidsus Polrestabes Kota Palembang terkait klarifikasi terhadap laporan atas dugaan pelanggaran Maklumat Kapolri.
Saat di mintai keterangan terkait panggilan tersebut, Bung Sukma Hidayat mengatakan bahwa sebagai warga negara yang taat akan hukum, maka kami memenuhi panggilan guna memberikan klarifikasi terkait laporan tersebut. Kamis (11/6).
Sukma menambahkan bahwa saat dimintai keterangan terkait dengan dasar hukum atas dugaan yang telah dilakukan oleh Walikota Palembang H. Harnojoyo, S.Sos adalah maklumat kapolri, peraturan wali kota (Perwali) No 6 Tahun 2020 Tentang PSBB.
Dalam klarifikasi tersebut Bung Sukma menyampaikan kepada pihak penyidik bahwa di dalam Maklumat Kapolri, yang berbunyi : Tidak mengadakan kegiatan sosial kemasyarakatan yang menyebabkan berkumpulnya massa dalam jumlah yang banyak baik ditempat umum maupun dilingkungan sendiri yaitu terdapat pada point ketiga dan kelima .
“Adapun bunyi dari point 3 dan 5 tersebut, yakni pada point ketiga berbunyi bahwa kegiatan Olahraga, Kesenian dan Jasa Hibura. dan pada point kelima berbunyi bahwa kegiatan lainnya yang menyebabkan berkumpulnya massa.” ungkap Bung Sukma.
“Berdasarkan kedua point tersebut, maka Walikota Palembang H. Harnojoyo, S.Sos dapat diduga telah melanggar Maklumat Kapolri dan kami meminta kepada pihak penyidik untuk memberlakukan sanksi sesuai KUHP pasal 216 ayat 1 dan 218.” tegas Bung Sukma.
Ditambahkan Bung Sukma bahwa dugaan atas pelanggaran yang disinyalir dilakukan oleh Wali Kota Palembang juga melanggar Perwali No 6 Tahun 2020 tentang PSBB Pasal 16 yang berbunyi :
1. Selama pemberlakuan PSBB, dilakukan pemberhentian sementara atas kegiatan sosial dan budaya yang menimbulkan kerumunan massa.
2. Kegiatan sosial dan budaya sebagaimana yang dimaksud pada ayat (1) termasuk pula kegiatan yang berkaitan perkumpulan atau pertemuan poin pada poin C . Hiburan.
“Sehingga patut di duga bahwasanya Wali Kota Palembang H. Harnojoyo, S. Sos telah melanggar Perwali No 6 Tahun 2020 yang ditanda tanganinya sendiri.” ujar Bung Sukma.
