MANGUPURA, beritaterkini.co.id | Kasus dugaan korupsi LPD Sangeh dengan kerugian milyaran rupiah hingga saat ini masih bergulir. Namun penanganan kasus tersebut masih menjadi tanda tanya bagi banyak kalangan.
Pasalnya, Jaksa Penuntut Umum (JPU) dari Kejaksaan Tinggi (Kejati) Bali, hingga saat ini hanya menahan satu terdakwa, yakni Nyoman Agus Aryadi yang merupakan mantan Kepala LPD Sangeh. Sementara dari fakta persidangan banyak pihak terlibat dalam kasus ini.
“Ini yang saya herankan, kenapa Jaksa hanya menahan satu orang. Padahal banyak yang terlibat korupsi. Penanganannya harus adil dan transparan dong, jangan tebang pilih,” ujar salah seorang tokoh masyarakat Sangeh yang mengaku kecewa dengan penanganan kasus tersebut, Sabtu (4/3/2023).
Warga lain juga mengungkapkan, ada aliran dana LPD yang masuk ke pribadi-pribadi pengurus lainnya dan itu merupakan fakta persidangan. Namun kenyataannya JPU hanya menetapkan satu tersangka. Sementara oknum pengurus LPD yang lainnya justru dijadikan saksi.
“Ini kan sudah tidak benar, banyak yang menikati dana LPD untuk kepentinggan pribadi, tapi kenapa dibiarkan tidak ditahan,” terang warga lainnya.
Dalam persidangan sebelumnya, tepatnya pada Kamis, 23 Februari 2023 lalu dengan agenda pemeriksaan saksi, Majelis Hakim Pengadilan Tipikor Denpasar yang dipimpin oleh Agus Akhyudi dengan tegas memerintahkan JPU agar memproses semua pihak yang diduga terlibat dalam kasus korupsi dana LPD Sangeh tersebut.
Perintah tegas Majelis Hakim Pengadilan Tipikor tersebut berkaitan dengan dakwaan JPU yang mendakwa kasus korupsi tersebut dilakukan bersama-sama. Sudah sepatunya yang diduga turut melakukan perbuatan melanggar hukum harus diproses.
Saat persidangan tersebut, terungkap ada tiga orang yang diduda terlibat diantaranya, Ni Wayan Suci selaku kepala bagian kredit, Ni Ketut Deni Harum Sari sebagai staf bagian kredit dan Gusti Ayu Wikani sebagai kasir atau bendahara.
“Anehnya, ketiga orang tersebut hanya sebagai saksi. Padahal jelas keterlibatannya. Ini kan aneh, jangan-jangan JPU masuk angin,” imbuh sumber.
Karena itu, warga meminta pihak JPU dari Kejati Bali segera memproses hukum orang-orang yang diduga terlibat dan menahannya, sesuai perintah Majelis Hakim saat persidangan beberapa waktu lalu. Langkah ini harus diambil Jaksa untuk menghindari persepsi miring terhadap institusi Kejaksaan di masyarakat.
Selain ketiga orang saksi yang pernah dihadirkan dalam persidangan, masih ada lagi orang yang diduga terlibat dalam kasus korupsi LPD Sangeh, diantaranya Ida Bagus Dipayana yang merupakan mantan Bendesa dan Ida Bagus Anom Karang selaku Komisaris Bank Sangeh serta I Made Sudiarta.
Sementara itu, Plt Kepala LPD Desa Adat Sangeh, Badung, Ida Bagus Nyoman Karang, telah menyerahkan uang titipan kepada Jaksa Penuntut Umum (JPU) Kejaksaan Negeri (Kejari) Badung, Rabu, 1 Maret 2023 lalu.
Karang menyerahkan uang sebesar Rp 309.499.600. Uang tersebut dititipkan sebagai barang bukti, kasus dugaan korupsi LPD Desa Adat Sangeh.
Uang yang diserahkan ke JPU tersebut, merupakan uang yang diperoleh pengurus LPD dari jasa produksi sebesar 10 persen. Sebagaimana diatur dalam Perda Bali Nomor 8 Tahun 2002, dari keuntungan fiktif yang dibuat oleh terdakwa I Nyoman Agus Aryadi.
Kepala Kejaksaan Negeri (Kajari) Badung Suseno dalam siaran tertulisnya, Kamis 2 Maret 2023 mengatakan, uang titipan yang diserahkan tersebut dijelaskan bersumber dari pengurus LPD atas jasa produksi sebesar 10 persen. Semestinya pengurus LPD tidak mendapatkan jasa produksi itu karena LPD tidak mendapatkan keuntungan.
Menurut Suseno, dengan terlaksananya penyerahan uang atas jasa produksi hasil dari keuntungan fiktif yang dilakukan oleh terdakwa Agus Aryadi maka menunjukan optimalisasi pengembalian keuangan negara akibat tindak pidana korupsi.
Untuk diketahui, terdakwa Agus Aryadi merupakan mantan Ketua LPD Desa Adat Sangeh didakwa secara bersama dengan pengurus tidak memperhatikan prinsip kehati-hatian dalam pengelolaan LPD dengan cara membuat kredit fiktif dan membentuk manajemen laba semu sejak tahun 2016 s/d 2020.
Selain itu juga telah membuat dan meloloskan kredit fiktif dengan mencatut nama nasabah LPD Desa Adat Sangeh yang pernah mengajukan kredit serta meloloskan nasabah yang berasal dari luar Desa Adat Sangeh secara sepihak tanpa adanya persetujuan dari Badan Pengawas LPD Desa Adat Sangeh. Seolah-olah LPD Desa Adat Sangeh memperoleh keuntungan sehingga pengurus LPD berhak untuk memperoleh jasa produksi.
Terkait perkara yang sudah masuk ke persidangan, terdakwa Agus Aryadi telah didakwa melakukan tindak pidana sebagaimana diatur dan diancam pidan dalam Primair Pasal 2 ayat (1) jo Pasal 18 UU PTPK jo Pasal 55 ayat (1) ke-1 KUHP. Subsidiair Pasal 3 jo Pasal 18 UU PTPK jo Pasal 55 ayat (1) ke-1 KUHP, lebih subsidiair Pasal 9 jo Pasal 18 UU PTPK jo Pasal 55 ayat (1) ke-1 KUHP. (ded/sdp)
