Halim Ali di sejumlah media cetak maupun elektronik, yang menyatakan bahwa HGU PT. SKB dinyatakan sah oleh Kanwil BPN Sumsel dan Pernyataan Haji Halim Ali yang menyatakan Klaim sepihak menguasai tanah (punya tanah) di atas IUP PT. GPU, dinilai tidak benar.
Hal itu dikatakan Oleh PT. Gorby Utama Putra melalui Direktur Utama, Wayan bersama kuasa hukum PT Gorby Putra Utama, Sofhuan Yusfiansyah dalam rilis yang diterima nedia sumsel.jarrakpos.com Kamis (13/4/2023).
“Adalah sangat tidak benar dan memutar balikkan fakta PT. GPU telah memiliki izin sejak Tahun 2007 dan menguasai, membebaskan. memberi lahan dari masyarakat sejak tahun 2009, sedangkan PT. SKB HGUnya baru terbit Tahun 2022,” tegas Sofhuan.
Menurut dia, PT GPU perlu menyampaikan Klarifikasi supaya semua pihak dapat mengetahui informasi yang sebenarnya secara utuh dan tidak diputarbalikkan. bahwa, PT Gorby Putra Utama (GPU) adalah salah satu perusahaan swasta Nasional yang pemiliknya adalah warga Negara Indonesia Asli. Sejak tahun 2009 PT Gorby Putra Utama (PT GPU) telah memiliki Izin Usaha Pertambangan Operasi Produksi (“IUP-OP”) dan perizinan terkait lainnya, serta telah memperoleh Sertifikat Clean & Clear dari Direktur Jenderal Mineral dan Batubara Kementerian ESDM Republik Indonesia DAN PT GPU telah melakukan Kegiatan Penambangan dan sudah berproduksi sejak tahun 2010.
“GPU Telah melaksanakan pembebasan/Ganti Rugi/Pembayaran tanah seluas kurang lebih 2000 Ha dari Masyarakat Desa Beringin Makmur yang diketahui dan disetujui oleh pejabat pemerintah setempat, sesuai dengan Letak lokasi dan titik koordinat IUP-OP PT GPU yaitu Desa Beringin Makmur II, Kecamatan Rawas Ilir, Kabupaten Musi Rawas Utara (d/h Kabupaten Musi Rawas), Provinsi Sumatera Selatan.
PT Gorby Putra Utama (PT. GPU) telah melakukan pembangunan infrastruktur pendukung yaitu jalan angkutan batubara (hauling road) Kabupaten Musi Rawas Utara menuju ke pelabuhan khusus dengan total panjang ± 130 km. Dan juga telah membangun fasilitas berupa Bangunan Perkatoran, Bangunan Tempat Tinggal Karyawan yang saat ini di huni oleh 1000 orang karyawan, bangunan penyimpanan bahan bakar minyak, bangunan bengkel untuk perbaikan alat tambang dan Fasilitas Pendukung Lainnya,” jelas dia.
Sofhuan menjelaskan, masalahnya Muncul Ketika Pihak BPN pada tanggal Februari tahun 2022 Menerbitkan Sertifikat Hak Guna Usaha (SHGU) Nomor : 00146/Muba atas nama PT. Sentosa Kurnia Bahagia milik Haji Halim. Berdasarkan hasil Rapat dengan pihak Kanwil BPN Provinsi Sumatera Selatan diketahui bahwa lokasi HGU Milik PT. SKB ternyata salah posisi (Harusnya HGU berada di wilayah Muba) akan tetapi pada kenyataanya letak lokasi HGU tersebut berada di Kabupaten Musi Rawas Utara berjarak kurang lebih 40 KM dari perbatasan Kabupaten Muratara dan Muba dan kesalahan tersebut secara lisan telah diakui oleh Kanwil BPN Sumatera Selatan pada Rapat tanggal 29 Maret 2023 di Kantor ATR/BPN Sumsel yang dihadiri oleh Asisten I Pemerintahan Provinsi Sumatera Selatan, Kepala Dinas Energi dan Sumber Daya Mineral Provinsi Sumatera Selatan dan Direktur Utama PT. Gorby Putra Utama Bersama tim Lawyer PT. GPU.
“Kami dari Pihak Kuasa Hukum PT. GPU merasa heran dan diluar nalar atas dasar apa BPN menerbitkan Sertifikat HGU tersebut padahal sebelum Setifikat HGU diterbitlan pihak PT. GPU telahberkirim surat KEBERATAN ke BPN untuik tidak menerbitkan HGU dan pihak BPN telah menjawab secara resmi dan Pihak BPN dan surat surat yang dikirim PT GPU juga telah ditanggapi oleh BPN (Pusat) dan BPN Kanwil Sumatera Selatan melalui surat-suratnya,” kata dia.
Adapun surat itu yakni BPN Kanwil Sumatera Selatan No. 2342/9-16/VII/2012 tanggal 10 Juli 2012, Surat BPN No. 2902/14.3-300/VIII/2012 tanggal 9 Agustus 2012 dan Surat BPN No. 3514/25.3-500/X/2012 tanggal 3 Oktober 2012. Bahwa Pada pokoknya surat tanggapan BPN tersebut di atas menyatakan bahwa BPN : 1. Belum pernah melakukan pengukuran dan pemrosesan penerbitan Hak Guna Usaha atas lokasi tanah yang dimaksud; dan 2. Pada prinsipnya tidak akan memproses permohonan hak atas tanah sepanjang masih ada permasalahan dengan orang/pihak lain atas lokasi yang akan dimohonkan haknya oleh siapapun.
“Kami mempertanyakan ke pihak BPN kenapa bisa menerbitkan HGU PT. SKB Padahal dilapangan ada Ijin Usaha Pertambangan (Tambang Aktive) dan Hak tanah Milik PT. GP. Kami menduga terbitnya HGU tersebut tidak melalui proses ketentuan dan Tidak Dilakukan verifikasi ke Lapangan.
Di mana seharusnya sesuai dengan peraturan perundangan yang berlaku proses penerbitan HGU wajib melakukan Verifikasi yang salah Satu Point Utamanya harus mendapat Persetujuan dan Pemegang Saham IUP karena keberadaan IUP PT. GPU lebih dulu ada dan lahan sudah diganti rugi dari masyarakat sejak tahun 2007. Serta terdapat tambang aktif yang sudah berproduksi sejak tahun 2010,” tandasnya
“Kami memohon perlindungan atas investasi yang sudah ditanamkan oleh PT GPU dan meminta keadilan dan berharap Bapak Presiden Joko Widodo selaku Presiden Republik Indonesia dan penegak hukum (KPK, POLRI, Kejaksaan) dapat melakukan penegakan hukum dan memberikan keadilan,” ujarnya.
Saat ini PT GPU dalam melakukan upaya hukum telah melaporkan ke Reserse Kriminal Umum Polda Sumsel untuk atas dugaan terbitnya HGU yang tidak sesuai Prosedur dan Perampasan secara sewenang-wenang Lahan PT GPU.
“Dan Kami yakin kepada Bapak Kapolri, Bapak Kapolda Sumsel untuk mengusut tuntas dan memproses secara hukum sampai Ke meja hijau (Pengadilan). Dalam waktu dekat pihak PT GPU akan melakukan Laporan Resmi ke Komisi Pemberantasan Korupsi (KPK) di Jakarta,”tegasnya (Rilis)
