Penetapan Tersangka Sengketa Merek ‘Fettucheese’ Dinilai Keliru, Perjuangan Pembuat Adonan Ditolak PN Denpasar
Denpasar, beritaterkini.co.id – Perjuangan dalam sidang Praperadilan di Pengadilan Negeri (PN) Denpasar, atas status penetapan tersangka Olfi Hargono (44) dan tersangka Tan Alex Christanto (50) berujung hasil penolakan oleh Hakim Tunggal, IGNA Aryanta Era W., SH., MH., Senin (26/6/2023) di Ruang Sidang Sari PN Denpasar Kelas I A. Sidang praperadilan menyoal merek ‘Fettucheese’, dalam bentuk produk snack stick keju sebelumnya, Rabu (21/6/2023) sempat menghadirkan saksi Ahli Pidana dan Kriminologi Dr. Gde Made Swardhana. Sebelumnya, merek stick keju milik Alex Christanto bernama ‘La Vallo Fettucheese’, lalu merek untuk milik TH (kakak dari Olfi-red) bernama ‘Fettucheese Teni’.
Diduga TH mendaftarkan produknya pada akhir November 2022, lalu Alex mendaftarkan di awal Desember 2022. Olfi sendiri bekerja serabutan pada Usaha Mikro Kecil dan Menengah (UMKM) stick keju merek La Vallo Fettu Cheese. Olfi merasa dia bukan pemilik merek dan juga bukan pemilik badan usaha (UD. Atamimi Bali). Sebaliknya, Olfi hanya pekerja tukang adon dalam membuat stick keju. Kini, sidang pun menghasilkan putusan penolakan terhadap permintaan tersangka Olfi Hargono dan tersangka Tan Alex Christanto atas kasus dugaan Perdagangan Merek Tanpa Izin oleh Pemilik. Di mana Olfi dan Alex diduga disangkakan Pasal 100 Ayat 2.
“Saya menghargai putusan praperadilan yang dijatuhkan Pengadilan Negeri Denpasar. Namun demikian, saya tetap pada pendapat saya bahwa penetapan tersangka yang dilakukan Polda Bali atas saya adalah jelas-jelas keliru dan melanggar hukum. Sebab sampai detik ini tidak ada satupun SK dari Kemenkumham ataupun pejabat berwenang lainnya, yang menolak pendaftaran merek La Vallo karena mengandung persamaan pada pokoknya. Selain itu, tidak ada satupun bukti yang diajukan oleh Polda Bali yang menunjukkan saya sebagai pemilik merek atau pun pemilik badan usaha yang memakai merek La Vallo,” ujar Olfi Hargono usai putusan sidang.
Di dalam sidang tersebut tampak pula dihadiri kuasa pemohon. Kemudian termohon dari Polda Bali diwakili Kasubdit Bidkum Polda Bali AKBP Ketut Soma Adnyana, bersama timnya. Olfi Hargono dan rekannya Alex Christanto diketahui mereka baru sekitar sebulan melakoni kerja sama usaha pembuatan snack stick keju. Atas peristiwa atau musibah yang dialami Olfi, ia pribadi menyesali pelaporan dari kakak kandungnya inisial TH. Bahkan, di antara Olfi, Alex, dan pelapor TH tidak pernah terdapat masalah apapun sebelumnya. Sengketa merek tersebut, diketahui apabila Olfi bukanlah pemilik usaha. Pemilik usaha atau merek adalah Alex. Sayangnya, justru Olfi turut terseret sebagai tersangka. Olfi sendiri bekerja sama dengan Alex dalam usaha stick keju.
“Saya tetap percaya bahwa cepat atau lambat Tuhan akan memunculkan kebenaran saya seperti matahari yang terbit. Dan semua orang yang mengkriminalisasi kami akan menerima akibat mereka masing-masing,” tuturnya. Perbedaan merek stick keju, yang mana sama-sama masih dalam proses pengajuan atau pendaftaran merek di Kemenkumham RI. Di mana kedua-duanya memiliki rentan waktu pendaftaran hanya seminggu, kedua-duanya juga belum memiliki sertifikat yang resmi. Sedangkan, diduga surat penetapan di Polda hanya ada kata ‘Fettucheese’ tidak ada Teni-nya. Bilamana mengacu pada kata Fettucheese, dalam artian ini masih sama-sama dalam proses mendaftar dan belum keluar sertifikat.
Sehingga, diduga tidak ada legal standingnya untuk mempidanakan Olfi dan rekannya alex. “Saya akan tetap berjuang bukan karena saya benci pelapor yang adalah kakak kandung saya, namun karena yang saya perjuangkan adalah suatu kebenaran yang hakiki, yaitu saya berhak untuk bisa berusaha dan bekerja dengan bebas tanpa intimidasi pemidanaan dari siapapun. Polda Bali atau pihak lain mana pun boleh saja mengingkari kebenaran tersebut, tapi mereka tidak dapat menghindari kebenaran. Dan sekali lagi saya tekankan bahwa saya tidak membenci kakak saya. Saya masih berharap bisa kembali rukun dengan kakak saya,” pungkasnya.
Sebelumnya, Olfi Hargono dan Alex Christanto juga mengaku baru sebulan melakoni kerjasama usaha pembuatan snack stick keju. Olfi begitu menyesali pelaporan kakak kandungnya inisial TH. Pun Antara Olfi, Alex dan juga pelapor T tidak ada masalah apapun sebelumnya. “Ini kan sengketa merek, beliau (Olfi) bukan pemilik usaha. Pemilik usaha atau merek adalah saya (Alex). Tetapi, saya dan bu Olfi ditetapkan sebagai tersangka. Kita ini adalah teman. Olfi ini bekerja sama dengan saya (usaha stick keju). Tapi, yang melaporkan kakaknya sendiri (T),” ujar Alex. Merek stick keju milik Alex bernama ‘La Vallo Fettucheese’, lalu untuk milik T bernama ‘Fettucheese Teni ’. Diduga T mendaftarkan produknya pada akhir November 2022, lalu Alex mendaftarkan di awal Desember 2022.
“Mereknya beda. Sama-sama masih dalam proses pengajuan atau pendaftaran merek di Kemenkumham RI. Di mana kedua-duanya memiliki rentan waktu pendaftaran hanya seminggu, kedua-duanya juga belum memiliki sertifikat yang resmi. Sedangkan, diduga surat penetapan di Polda hanya ada kata ‘Fettucheese’ tidak ada Teni-nya. Kita berpatokan kepada Fettucheese dong? Kalau kita berpatokan dengan Fettucheese, artinya ini masih sama-sama dalam proses mendaftar dan belum keluar sertifikat. Jadi kan tidak ada legal standingnya untuk mempidanakan kita,” tegasnya. Sebelumnya, diungkapkan Olfi, dia bekerja serabutan pada Usaha Mikro Kecil dan Menengah (UMKM) stick keju merek La Vallo Fettu Cheese.
Pra peradilan terhadap dirinya diharapkan dapat dikabulkan, sebab Olfi merasa dia bukan pemilik merek dan juga bukan pemilik badan usaha (UD. Atamimi Bali). Tidak ada satupun nama Olfi di akta pendirian UD atau pun perjanjian tertulis lainnya. Diduga Polda Bali menetapkan seseorang menjadi tersangka hanya berdasarkan asumsi, bukan kepastian hukum. “Ini perusahaan kecil yang baru dirintis, saya sendiri kerja serabutan. Apa yang bisa saya kerjakan, saya bantu kerjakan,” ucap Olfi. Sejak Olfi dilaporkan yang pertama ke Polda Bali dan Alex dilaporkan yang kedua. Olfi mengaku disiplin memenuhi panggilan aparat untuk memberikan klarifikasi dalam undangan Dumas pertama, Senin, 23 Januari 2023. Olfi pun kepada wartawan mengaku sudah berusaha menghubungi untuk saling bermediasi dengan sang kakak T.
Meski Olfi dan para customer-nya sempat mengalami gangguan bisnis, tetapi tetap diam bersabar. “Saya dipanggil untuk undangan klarifikasi, sebagai warga Negara yang baik tentu datang. Ditanya saya jawab, tapi sekali lagi saya menempatkan diri bukan sebagai pemilik merek dan bukan pemilik usaha. Kalau saya ditetapkan sebagai tersangka, inilah upaya saya untuk mencari keadilan (praperadilan). Ditetapkan tersangka, saya dan Pak Alex diduga melanggar merek Fettucheese. Sedangkan merek Fettucheese milik T, posisinya sama dengan merek La Vallo Fettucheese-nya Pak Alex, di mana masih dalam proses pendaftaran di Kemenkumham RI, sampai kini juga merek Pak Alex belum ada penolakan dari Kemenkumham RI. Dan belum ada melanggar merek lain,” bebernya.
Olfi merasa bilamana kasus dugaan kasus perdagangan merek tanpa izin oleh pemilik, masih dapat dipertimbangkan kembali. Hal ini mengingat antara Olfi Hargono dan pelapor inisial T merupakan saudara kandung alias berstatus kakak adik. Bahwa patut ketahui kasus merek bukan pembunuhan, pencurian atau narkoba. Sehingga bilamana sampai Pra Peradilan pemohon Olfi ditolak, patut diduga Hakim Tunggal mengalami ‘rasa takut’ dengan pemberitaan media yang selama ini beredar, sehingga mengesampingkan dasar-dasar hukum di negara ini. “Kami mohon keadilan dan kepastian hukum di negara ini, agar nantinya seorang Warga Negara Indonesia bisa dilindungi hak-haknya, apalagi UMKM seperti kita. Bagaimana bisa seorang karyawan yang bekerja membuat adonan stick keju bisa dijadikan tersangka pelanggaran merek,” tutur Olfi.
Ditambahkan saksi ahli Gde Swardhana bahwa hubungan kakak adik, Olfi dan T semestinya masih dapat dimediasi, sebab merek Fettucheese masing-masing sudah berbeda. “Ini semua masih dalam usulan dari masing-masing pihak (Ke Kemenkumham RI). Jadi sama mereknya adalah Fettucheese, tapi yang usulkan kakaknya adalah Fettucheese Teni. Sedangkan, dengan nama La Vallo Fettucheese kan tentu saja berbeda. Sama seperti nama Betutu (Perumpamaan-red), Betutu adalah ayam, ada merek Betutu Men Tempeh, Betutu Gilimanuk, dan lain-lainnya. Ini saja sudah jelas saya beri contoh gambaran,” tegasnya. 021/002
