Palembang,Berita Terkini.Co.Id Tim Kuasa Hukum Sri Wahdiah selaku tergugat dalam perkara nomor 49/PDT.G/2023/PN.PLG melawan Ecep Arjaya selaku penggugat menyampaikan apresiasi yang setinggi-tingginya Kepada Majelis Hakim yang telah mengabulkan eksepsi kami selaku tergugat terkait gugatan kurang pihak, oleh Ketua Majelis Hakim Taufik Rahman, SH

Klein kami Sri Wahdiah adalah pemilik perumahan Yasera Damai Regency yang terletak di kelurahan Sungai Selinca Kecamatan Kalidoni Kota Palembang,”ungkap Kuasa Hukum Tergugat Dari Kantor Hukum MJP & Partners M.Jasmadi Pasmeindra SHI,MH.MED.CLMA, Anwar Sadad,SH,Bagus Edy Gunawan,SH,MH, Randi Indra Yangga,SH,Deny Setia Budi, Bertempat di warung Konsultasi Hukum AUK Nusantara jalan Bidar(17/07/23).

Dijelaskan M.Jasmadi Pasmeindra SHI,MH.MED.CLMA, Klien kami adalah pemilik tanah tersebut berdasarkan SHM yang di terbitkan oleh BPN Kota Palembang pada Bulan Februari 2019,selama 2 tahun kondisi tanah tersebut mengalami banjir jika hujan deras sehingga klein kami melakukan penimbunan dua kali pada tahun 2021.Kondisi tanah tersebut sudah tinggi sehingga klein kami membangun dua rumah contoh untuk di pasarkan,”jelasnya .

Pada tanggal 28 Mei 2021 sekitar pukul 10.30.wib, datang lah Ecep Arjaya selaku penggugat dan anak buah nya untuk melakukan pematokan dan mengaku itu adalah tanah miliknya berdasarkan surat keterangan No.AG.120/114/SM /TL/1983.”Sehingga,tidak benar kalau Ecep Arjaya sering sekali mengingat klein kami”beber Jasamadi.

Kami Kuasa Hukum Tergugat Dari Kantor Hukum MJP & Partners M.Jasmadi Pasmeindra SHI,MH.MED.CLMA, Anwar Sadad,SH,Bagus Edy Gunawan,SH,MH, Randi Indra Yangga,SH,Deny Setia Budi,SH.menanggapi hak jawab pemberitaan di media online trikpos.com pada tanggal 7 Juni 2021,kami tim kuasa hukum melaporkan Ecep Arjaya yang saat itu berpangkat Letkol (MPP) ke DENPOM II/4 Palembang, Laporan atas dugaan tindak pidana dengan sengaja memasuki pekarangan orang lain tanpa izin dan ancam kekerasan.” ujarnya.

Ditambahkan,Dalam proses penyelidikan pihak DENPOM II/4 Palembang melakukan pemeriksaan terhadap saksi-saksi yang berkenaan dengan tanah klien kami Dan dilakukan pengukuran ulang oleh pihak BPN Palembang dan hasil dari pengukuran ulang tersebut adalah sesuai dengan sertifikat atas nama klien kami Sri Wahdiah tertuang dalam berita acara tentang pengukuran ulang No. 19/71/BPN/2021,
bahwa setelah mengumpulkan bukti surat dan keterangan saksi hasil gelar perkara terhadap hal tersebut Surat keterangan hak usaha No. AG. 120/114/SM/TL/1983 yang dimiliki oleh Ecep Arjaya (Penggugat) tidak bersesuaian dengan objek tanah milik klien kami,” ucap dia.

Dalam perjalan proses penyelidikan di DENPOM II/4 Palembang atas laporan klien kami, terhadap Ecep Arjaya (Penggugat). Pada tanggal 22 Juli 2021, Klien kami di laporkan ke Polda Sumsel atas dugaan tindak pidana pemalsuan surat dan atau dokumen palsu diatas akta autentik dan atau penyerobotan tanah dan atau fitnah dan Laporan tersebut di SP3 nomor: SP2-Lidik/612.6/IV/2022 karena belum di temukan tindak pidana.
“Artinya sudah jelas bahwa tanah tersebut memang milik klien kami. Dalam Posita gugatannya penggugat menyatakan bahwa Penggugat sering melakukan perawatan tanah seperti membersihkan dan menebas rerumputan yang menjadi pertanyaan sesering apa hal itu dilakukan sampai penggugat tidak mendaftarkan tanahnya di Sungai Selincah Kecamatan Kalidoni. Dengan adanya putusan hari ini semakin jelas bahwa klien kami adalah pemilik sah tanah tersebut.

Kami sampaikan bahwa kepada para calon konsumen atau yang telah menjadi konsumen jangan ragu bahwanya keberadaan Perumahan Yassera Damai Regency adalah sah secara hukum karena sudah memiliki Sertipikat,”pungkasnya.(RZP).
