Diduga Langgar Prosedur, Kuasa Hukum Warga Desa Adat Bugbug Minta Penangguhan Penahanan

Denpasar, beritaterkini.co.id – Warga Bugbug kembali turun bersama, dengan berkumpul di GOR Ngurah Rai, Denpasar terlebih dahulu, pada Selasa siang (19/9/2023), sebelum menuju Polda Bali. Mereka kompak datang untuk memberi dukungan atas pemanggilan warga Bugbug yang diduga terlibat kasus pembakaran resort mewah yang diberi nama Detiga Neano Resort yang pembangunannya tetap tegas ditolak warga Desa Adat Bugbug, karena disinyalir masih berada di kawasan suci Pura Gumang, Desa Bugbug, Karangasem yang terus bergulir. Tim kuasa hukum yang mendampingi secara langsung meminta Polda Bali segera menangguhkan penahanan 13 warga Bugbug yang telah ditetapkan sebagai tersangka yang dituduh melakukan perusakan hingga pembakaran resort tersebut.

Warga Bugbug yang diseret kasus tersebut menjalani pemeriksaan sebagai saksi atas kasus pembakaran dan pengerusakan Resort Detiga Neano menjalani pemeriksaan secara bergilir. Para saksi mengaku aksi tersebut merupakan spontanitas. Para saksi tersebut didampingi oleh Tim Kuasa Hukum dan warga Bugbug lainnya yang mengenakan pakaian adat madya. Pada kesempatan itu, Kuasa Hukum Warga Desa Adat Bugbug, Erwin Siregar mengatakan hingga kini 13 warga Desa Bugbug masih ditahan oleh Direktorat Reserse Kriminal Umum (Ditreskrimum) Polda Bali. “Untuk yang 13 (yang jadi tersangka, red) kemarin, tangguhkan saja penanganannya,” tandasnya, seraya menyayangkan sikap pihak Polda Bali yang langsung menahan mereka saat penetapan tersangka. Erwin Siregar menjelaskan, sejatinya Penyidik Subdit III Direktorat Reserse Kriminal Umum Polda Bali memanggil 15 orang untuk diperiksa.

Dari 15 orang yang dipanggil ini, dua orang merupakan perempuan dan, satu adalah anak laki-laki di bawah umur, masih pelajar tingkat SMA, namun salah satu di antaranya berhalangan. Kehadiran para saksi sebagai bukti menjadi warga negara yang baik dan taat hukum “Klien kami sampai sekarang 13 orang ditahan dan hari ini ada sekitar 15 orang akan diperiksa, kami tetap datang. Tetapi ada baiknya menurut saya jangan langsung diperiksa, langsung ditangkap, langsung ditahan,” tegas Erwin. Disinggung terkait apakah para saksi akan dijadikan tersangka jika mengaku bersalah? Erwin sebut penyidik tidak serta-merta langsung menangkap dan melakukan penahanan setelah pemeriksaan. Dia pun menginginkan agar warga Bugbug yang sudah jadi tersangka ditangguhkan penahanannya. Dikatakan, para penasehat hukum yang hadir bersama beberapa tokoh akan memberikan jaminan bahwa tidak ada pengulangan persangkaan terhadap pembakaran villa tersebut.

Warga Desa Adat Bugbug berharap pihak kepolisian yang menangani masalah tak hanya melihat dari sudut pandang hukum dengan menuntut warga Bugbug saja. Tetapi, juga perlu memproses owner atau kontraktor villa agat menyelesaikan syarat-syarat untuk melakukan pembangunan. Sambil menunggu hasil kajian terkait bisa atau tidaknya villa tersebut dibangun, maka menurutnya pembangunan perlu dihentikan sementara. Erwin juga meminta agar pengusaha dan kontraktor menghentikan sementara pembangunan Detiga Neano Resort. Penghentian sementara itu diperlukan untuk menunggu hasil kajian pembangunan resort yang berada di Bukit Gumang tersebut. Menurut Erwin investor maupun kontraktor resort tersebut perlu menyelesaikan syarat-syarat pembangunan. Erwin menjelaskan bahwa permohonan penangguhan penahanan terhadap warga Desa Bugbug yang menjadi tersangka sudah dilakukan. Hanya saja, permohonan itu belum dijawab oleh Ditreskrimum Polda Bali.

Ditambahkan, Tim Kuasa Hukum Warga Desa Adat Bugbug lainnya, Andreas, menilai Polda Bali melakukan pelanggaran prosedur dalam penetapan tersangka insiden perusakan resort di Bugbug. Menurutnya, tindakan itu telah melanggar Peraturan Kepala Kepolisian RI (Perkapolri) Nomor 6 tahun 2019 tentang Penyidikan Tindak Pidana. Dia menyebut selama ini Polda Bali belum melakukan gelar perkara atas penetapan tersangka terhadap 13 warga Bugbug. Sebab, mereka ditetapkan tersangka saat setelah dimintai keterangan. Selain itu, ada pelanggaran prosedur dalam penetapan tersangka kasus ini, karena penyidik tidak ada melakukan gelar perkara sesuai yang diatur Perkapolri 6 tahun 2014 di Pasal 45. “Perlu diadakan gelar perkara sebelum ditetapkan tersangka. Jadi, diatur di Perkapolri 6 Tahun 2019. Belum ada gelar perkara. Artinya penyidik melanggar prosedur seperti yang diatur dalam peraturan Kapolri,” sentilnya.

Di sisi lain, Kabidhumas Polda Bali Kombespol Jansen Avitus Panjaitan, sebelumnya memastikan penetapan 13 tersangka kasus pembakaran resort di Bugbug dilakukan secara transparan. “Polda Bali memeriksa dengan sangat transparan tidak ada intervensi dari pihak manapun,” katanya melalui keterangan pers Polda Bali, pada Minggu (17/9/2023). 021/002
