JAKARTA – BERITATERKINI.co.id – Komnas HAM menegaskan tak setuju hukuman mati bagi terpidana kasus tindak pidana korupsi.
“Kita tidak akan pernah berubah bahwa kita tidak bersepakat dengan hukuman mati, karena bagi Komnas HAM hak untuk hidup itu adalah hak asasi yang absolut,” ujar Ketua Komnas HAM Ahmad Taufan Damanik di Jakarta, Selasa, (10/12/2019).
Taufan menjelaskan jika sampai saat ini tidak ada argumentasi praktikal-substansial soal hukuman mati dalam rangka menyelesaikan masalah. Dia menganggap jika hukuman mati justru bertentangan nilai-nilai kemanusiaan.
Sehingga menurutnya hukuman mati tidak layak bagi terpidana kasus korupsi.
“Harus diingat, memberikan hukuman mati pada mereka itu tidak menyelesaikan persoalan. Oleh karena itu kita selalu mengatakan agar sistem hukum kita secara bertahap meninggalkan hukuman mati itu, termasuk pada koruptor,” ujar Taufan.
Sebelumnya, Presiden Joko Widodo mengatakan, hukuman bagi pelaku tindak pidana korupsi (tipikor) bisa saja diterapkan jika itu merupakan kehendak masyarakat.
“Kalau masyarakat berkehendak seperti itu dalam rancangan UU Pidana Tipikor (hukuman mati) itu dimasukkan,” kata Jokowi saat peringatan Hari Anti-Korupsi di SMKN 57, Jakarta, Senin (09/12/2019).
Pernyataan Presiden itu disampaikan saat ditanya soal kemungkinan penerapan hukuman mati kepada pelaku korupsi oleh siswa SMK Negeri 47 Jakarta.
“Mengapa negara kita mengatasi korupsi tidak terlalu tegas? Kenapa tidak berani (seperti) di negara maju misalnya dihukum mati? Kenapa kita hanya penjara tidak ada hukuman tentang hukuman mati?,” tanya Harli Hermansyah, siswa Kelas XII jurusan Tata Boga SMK Negeri 57, Jakarta, Senin.
“Kalau di undang-undang ada yang korupsi dihukum mati ya dilakukan tapi di UU tidak ada yang korupsi dihukum mati ,tidak ada betul Pak Menkumham?” jawab Jokowi, seraya bertanya dengan Menteri Hukum dan HAM, Yasonna H Laoly yang juga menghadiri acara tersebut.
Laoly lalu menjawab bahwa dalam UU Nomor 31/1999 tentang Pemberantasan Tindak Pidana Korupsi sudah ada aturan mengenai hukuman mati bagi pelaku korupsi tapi penerapannya terbatas.
