JAKARTA – BERITATERKINI.co.id – Advokat senior sekaligus Warga Binaan Pemasyarakatan (WBP) Lapas Sukamiskin, Bandung, OC Kaligis meminta agar Jaksa Agung membuka kembali kasus pencurian sarang burung walet yang ikut menyeret penyidik senior KPK yang waktu itu menjadi Kasatreskrim Polres Lampung, Novel Baswedan.
Demikian diketahui dari gugatan perdata yang dilayangkan OC Kaligis ke PN Jakarta Selatan.
OC Kaligis agar kasus Novel Baswedan segera disidangkan di PN Bengkulu.
“Memerintahkan para tergugat untuk melanjutkan penuntutan perkara atas nama Novel Baswedan bin Salim Baswedan untuk segera disidangkan di Pengadilan Negeri Bengkulu,” bunyi petitum permohonan OC Kaligis seperti dikutip di website Sistem Informasi Penelusuran Perkara Pengadilan Negeri Jakarta Selatan (SIPP PN Jaksel), Jumat, (08/11/2019).
Dalam permohonannya, OC Kaligis menggugat Jaksa Agung dan Kejaksaan Negeri Bengkulu. Gugatan itu terdaftar nomor perkara 091/Pdt.G/2019/PN.Jkt.Sel yang didaftarkan Rabu (6/11).
Sidang perdana akan digelar pada 4 Desember 2019. OC Kaligis meminta hakim menyatakan para tergugat melakukan perbuatan melawan hukum karena tidak melaksanakan isi putusan Praperadilan Pengadilan Negeri Bengkulu Nomor 2 Pid.Pra/2016/PN.Bgl tertanggal 31 Maret 2016.
OC Kaligis juga meminta tergugat untuk membayar ganti rugi sebesar Rp2 juta.
“Menghukum para tergugat untuk membayar ganti kerugian kepada penggugat secara tanggung renteng sebagai berikut: Kerugian Materiil bahwa sebagai akibat dari perbuatan melawan hukum yang dilakukan oleh para tergugat, maka penggugat mengalami kerugian materiil sebesar Rp 1 juta,” kata OC Kaligis.
Untuk diketahui, kasus dugaan penganiayaan yang menyeret Novel Baswedan saat menjadi Kasat Reskrim di Polres Bengkulu pada 2004 kembali diungkit. Kasus Novel disidik di Mabes Polri dan dinyatakan P21 pada 2015.
Setelah di Kejaksaan Negeri Bengkulu, jaksa kemudian membuat dakwaan dan sudah didaftarkan untuk disidang perdana di PN Bengkulu. Kemudian Kejari Bengkulu memutuskan menghentikan penuntutan.
Para korban yang mengaku sebagai korban penembakan anggota Polres Bengkulu kemudian mengajukan praperadilan. Gugatan praperadilan dikabulkan. Jaksa Penuntut Umum (JPU) diminta untuk segera mengembalikan berkas-berkas dakwaan dan berkas lainnya untuk dilakukan penuntutan, tetapi Novel belum didakwa.
