JAKARTA – BERITATERKINI.co.id – Menteri Koordinator Bidang Politik Hukum dan Keamanan, Mahfud MD mengatakan Basuki Tjahaja Purnama atau Ahok tetap bisa menjadi bos BUMN, jika memang sesuai dengan AD/ART BUMN.
BUMN, menurut Mahfud bukanlah jabatan publik lantaran bukan badan hukum publik namun badan hukum perdata.
“BUMN itu bukan badan hukum publik. Dia badan hukum perdata. Badan hukum perdata tunduk pada undang-undang PT, undang-undang perseroan terbatas, tunduk ke situ bukan undang-undang ASN,” kata Mahfud, Sabtu, (16/11/2019).
Mahfud menegaskan jika Ahok diangkat sebagai Komisaris BUMN, maka Ahok kerjanya sistem kontrak.
Pasalnya kata dia, Ahok tidak diangkat dalam sebuah jabatan publik.
“Lalu jangan orang (yang) tidak tahu men-caption lagi pernyataan saya dua tahun lalu bahwa orang mantan napi tidak boleh menjadi pejabat publik. Emang enggak boleh, tetapi kalau menjadi pejabat seperti badan usaha itu, itu perusahaan terserah AD/ART-nya di badan perusahaan BUMN ini,” ujar dia.
