JAKARTA – BERITATERKINI.co.id – Tiga tersangka kasus suap dan gratifikasi dalam pengurusan perkara di Mahkamah Agung (MA) kompak absen dalam pemeriksaan Komisi Pemberantasan Korupsi (KPK).
Tiga tersangka yakni mantan Sekretaris MA Nurhadi Abdurrahman, serta menantunya, Rezky Herbiyono dan Direktur PT Multicon Indrajaya Terminal (MIT) Hiendra Soenjoto.
Bahkan mereka juga tidak memberikan keterangan tentang alasan absen dari panggilan pemeriksaan KPK.
“Sampai sore hari tidak ada keterangan atau alasan apa pun soal mereka tidak bisa hadir ya,” kata Plt Juru Bicara KPK Ali Fikri di Gedung Merah Putih KPK, Jakarta Selatan, Jumat (03/01/2020).
Sedianya mereka akan saling dikonfrontir keterangannya satu sama lain untuk penyidikan perkara tersebut.
“Jadi berkas ini telah di splitsing (pemecahan berkas perkara), jadi nanti saling bersaksi,” ucap Ali.
Ali menegaskan penyidik KPK akan menjadwal ulang pemeriksaan kepada tiga tersangka tersebut. Namun ia tidak memastikan kapan mereka akan kembali dipanggil.
Mafia kasus yang sempat terkenal di MA itu dijerat dua perkara, yakni suap dan gratifikasi. Dalam perkara suap, Nurhadi diduga menerima suap Rp 33,1 miliar dari Hiendra melalui menantunya Rezky.
Suap itu diduga untuk memenangkan Hiendra dalam perkara perdata kepemilikan saham PT MIT. Nurhadi melalui Rezky juga diduga menerima janji 9 lembar cek dari Hiendra terkait perkara Peninjauan Kembali (PK) di MA.
Sementara, dalam kasus gratifikasi, Nurhadi diduga menerima Rp 12,9 miliar selama kurun waktu Oktober 2014 sampai Agustus 2016. Uang itu untuk pengurusan perkara sengketa tanah di tingkat kasasi dan PK di MA serta Permohonan Perwalian.
Mertua dan menantu itu lantas disangkakan melanggar Pasal 12 huruf a atau Pasal 12 huruf b subsider Pasal 5 ayat (2) subsider Pasal 11 dan/atau Pasal 12B Undang-Undang tentang Pemberantasan Tindak Pidana Korupsi jo. Pasal 55 ayat (1) ke-1 KUHP.
Sementara Hiendra disangkakan melanggar Pasal 5 ayat (1) huruf a atau Pasal 5 ayat (1) huruf b subsider Pasal 13 Undang-Undang tentang Pemberantasan Tindak Pidana Korupsi jo. Pasal 55 ayat (1) ke-1 jo. Pasal 64 ayat (1) KUHP.
