JAKARTA – BERITATERKINI.co.id – Indonesia Corruption Watch (ICW) menyambut baik putusan Mahkamah Konstitusi (MK) yang memgharuskan eks napi korupsi untuk menunggu selama lima tahun untuk bisa maju dalam pemilihan kepala daerah.
ICW memandang jika putusan MK sangat penting, dalam rangka menjaga marwah demokrasi.
“Menurut saya ini landmark decision, putusan penting yang tidak hanya bicara pemberantasan korupsi tapi demokrasi. Kami menilai putusan ini progresif,” kata Koordinator Divisi Korupsi Politik Indonesia Corruption Watch (ICW) Donald Fariz usai sidang pengucapan putusan di Jakarta, Rabu (11/12/2019).
Menurut dia, masa waktu tunggu sangat penting agar para eks koruptor tidak mengulangi kembali perbuatannya.
Ia mencontohkan kasus eks Bupati Kudus, M Tamzil yang terjaring KPK tahun 2019 lalu dalam kasus dugaan korupsi. Padahal dia baru saja bebas dari penjara tahun 2015 silam, dan kembali maju Pilkada Kudus tahun 2018 lalu.
“Masa jeda didesain untuk memberi waktu korektif bagi mantan terpidana korupsi untuk mengevalusi perbuatannya,” ujarnya.
Melalui Putusan No. 56/PUU-XVII/2019, MK memberlakukan kembali empat syarat kumulatif larangan bagi mantan narapidana (napi) dengan ancaman 5 tahun penjara—termasuk tindak pidana korupsi—untuk mencalonkan diri sebagai kepala daerah seperti pernah tertuang dalam Putusan No. 4/PUU-VII/2009.
Syarat itu adalah bukan untuk jabatan publik yang dipilih, berlaku untuk jangka waktu 5 tahun setelah menjalani pidana, terbuka menyatakan jati diri sebagai mantan terpidana, dan bukan pelaku kejahatan berulang (residivis).
Namun, syarat kumulatif tersebut berubah menjadi alternatif lewat Putusan MK No. 42/PUU-XIII/2015. Bekas terpidana tidak lagi dibatasi jeda 5 tahun, tetapi dapat mencalonkan diri cukup dengan mengumumkan pernah terpidana kepada publik.
Putusan MK No. 42/PUU-XIII/2015 kemudian diadopsi dalam Pasal 7 ayat (2) huruf g UU No. 10/2016 tentang Pemilihan Gubernur, Bupati, dan Wali Kota (UU Pilkada). Bunyinya, ‘tidak pernah sebagai terpidana berdasarkan putusan pengadilan yang telah memperoleh kekuatan tetap atau bagi mantan narapidana telah secara terbuka dan jujur mengemukakan kepada publik bahwa yang bersangkutan mantan terpidana’.
Menyadari fakta empiris berulangnya tindak pidana oleh bakas narapidana, MK kemudian mengembalikan syarat dalam Putusan No. 4/PUU-VII/2009 sehingga mengubah isi Pasal 7 ayat (2) huruf g UU Pilkada. Bedanya, jeda 5 tahun tidak berlaku bagi bekas napi tindak pidana kealpaan atau tindak pidana politik.
Donald Fariz menegaskan bahwa putusan MK tersebut berlaku sejak dibacakan. Karena itu, Komisi Pemilihan Umum (KPU) mesti mengubah kembali PKPU No. 18/2019 tentang Perubahan Kedua atas PKPU No. 3/2017 tentang Pencalonan Pemilihan Kepala Daerah agar dapat diterapkan dalam Pilkada 2020.
“Tidak butuh waktu lama untuk memperbaiki pasal, hanya tambahkan frasa ‘5 tahun’ jeda. Tidak perlu uji publik lagi,” tuturnya.
ICW merupakan pemohon pengujian Pasal 7 ayat (2) huruf g UU Pilkada bersama dengan Perkumpulan untuk Pemilu dan Demokrasi (Perludem). Para pemohon mendalilkan kasus Bupati Kudus M. Tamzil sebagai argumentasi untuk meyakinkan MK pentingnya jeda bagi mantan koruptor untuk mencalonkan diri dalam pilkada.
“Mengadili, mengabulkan permohonan para pemohon untuk sebagian,” ucap Ketua Majelis Hakim Konstitusi Anwar Usman saat membacakan amar Putusan MK No. 56/PUU-XVII/2019.
