BANTEN, WWW.BERITATERKINI.CO.ID, Polda Banten klarifikasi mengenai penyitaan buku Tan Malaka berjudul Menuju Merdeka 100 Persen dari salah satu mahasiswa yang ditangkap saat menggelar aksi unjuk rasa di depan kampus UIN Sultan Maulana Hasanudin (SMH) Banten, Selasa, 6 Oktober 2020 tidak ada kaitannya dengan penetapan tersangka terhadap mahasiswa tersebut
hal ini disampaikan oleh Kapolda Banten Irjen Pol Drs Fiandar melalui Kabidhumas Polda Banten Kombes Pol Edy Sumardi kepada awak media mengatakan bahwa Setelah melakukan pendalaman dan pemeriksaan lebih lanjut buku Tan Malaka berjudul Menuju Merdeka 100 Persen ini tidak terkait dengan barang bukti dalam Penetapan tersangka
“Mahasiswa OA (22) salah satu perguruan tinggi di Banten itu ditetapkan menjadi tersangka karena melanggar Pasal 212 KUHP,
dengan ancaman pidana paling lama 1,4 tahun bulan kurungan penjara, “Kata Edy Sumardi.
Edy sumardi menyampaikan dalam penjelasan Pasal 212 KUHP yaitu Barang siapa dengan kekerasan atau ancaman kekerasan melawan seorang pejabat
yang sedang menjalankan tugas yang sah, atau orang yang menurut kewajiban undang-undang atau atas permintaan pejabat memberi pertolongan kepadanya, diancam karena melawan pejabat, dengan pidana penjara paling lama satu tahun empat bulan atau pidana denda paling banyak empat ribu lima ratus rupiah.
“Saat Petugas melakukan himbauan untuk membubarkan masa karena sudah melebihi batas aksi dan mengganggu aktifitas masyarakat, Mahasiswa OA (22) ini melakukan kekerasan atau ancaman kekerasan melawan seorang petugas yang sedang bertugas, serta masa aksi unjuk rasa mulai melakukan aksi anarkis dengan melempari petugas dengan batu konblok (dengan berbagai ukuran) serta menembakan petasan api kepada petugas,”Ujar edy sumardi.
Edy Sumardi menjelaskan bahwa Polda Banten tidak hanya Focus menangani perkara yang disangkakan berdasarkan pasal 351 KUHP kepada Tersangka Utama, yang mengakibatkan Korban Terluka, tapi polisi juga tetap melakukan penyidikan kepada 13 Tersangka lainnya untuk berkasnya diproses hingga ke pengadilan.
“Adapun Buku Tan Malaka itu adalah buku yang di jual bebas di pasaran sehingga gak ada kaitannya dengan aksi demo anarkis kemarin, serta gak ada kaitannya dengan perkara yg di sangkakan.
Hanya saja, Saat Pelaku diamankan, ybs membawa sebuah tas ransel, dan kebetulan aja di dalam tas tersebut terdapat Buku TAN Malaka tersebut.
Sejauh ini memang gak ada kaitannya Buku tersebut, dengan aksi yang dilakukan oleh pelaku.
Aksi pelaku murni melanggar pasal 212 KUHP barang siapa dengan kekerasan atau ancaman kekerasan melawan petugas yang sedang bertugas,”Ujar edy sumardi.
