JAKARTA, BERITATERKINI.co.id-Menyikapi maraknya praktek penambangan ilegal, Dirjen Mineral dan Batu Bara Kementerian ESDM, Ridwan Djamaluddin menegaskan, Pemerintah telah menegaskan bahwa praktek ilegal harus dihentikan.
Pada prinsipnya, kata Ridwan, pemerintah tidak melarang masyarakat untuk melakukan usaha namun negara juga tidak dirugikan soal kewajiban membayar pajak, royalti dan lainnya. Selain itu, Pemerintah juga mengawal agar lingkungan tidak dirusak oleh praktek ilegal tersebut.
“Pemerintah lebih mementingkan dampak jangka panjang. Untuk melawan praktek penambangan ilegal, pemerintah meminta masyarakat melaporkan melalui media sosial agar publik dapat mempengaruhi mereka sadar untuk tidak melakukan hal itu ,” kata dia dalam acara Webinar Nasional yang diselenggarakan oleh Kaukus Muda Indonesia (KMI) bertema, “Evaluasi Sektor Pertambangan di tengah Maraknya Illegal Mining”, Kamis (24/6/2021).
Dalam kesempatan tersebut, Direktur Tipiter Bareskrim Polri, Brigjen Pol. Pipit Rismanto mengatakan, sektor pertambangan di Indonesia memiliki banyak masalah kompleks, yang seharusnya dimasa pandemi Covid-19 sektor ini memberikan kontribusi bagi perekonomian. Dari permasalahan pertambangan yang berhasil diinventarisir oleh kepolisian, permasalahan lebih banyak pada soal tata kelola yaitu penerbitan izin diawal.
Kemudian, lanjutnya, dalam menentukan tata ruang juga sering terjadi permasalahan, yang seharusnya diperlukan kompetensi-kompetensi tertentu agar tidak terjadi pelanggaran. Inilah sebagian permasalahan-permasalahan yang ditemukan kepolisian setelah dilakukan pemeriksaan dan penyidikan
“Kita tidak bisa menyalahkan proses penegakan hukum yang lemah saja, namun yang perlu dipertanyakan juga soal proses penerbitan izin pertambangan. Di daerah misalnya, seharusnya praktek penambangan diawali adanya rekomendasi teknis dari pemerintah setempat, namun hal ini tidak dilakukan. Endingnya yang disalahkan adalah penegak hukum,” ujarnya.
Pipit menambahkan, terkait penegakan hukum yang dilakukan oleh Polri mengalami transformasi yang awalnya mengejar keadilan retributif juga harus mengejar keadilan yang restoratif. Polri menganggap penegakan hukum sebagai alternatif terakhir.
“Kami memandang pertambangan ini juga harus bermanfaat bagi masyarakat ditengah pandemi. Kami mencermati kebijakan pemerintah maupun arahan bagaimana proses pertambangan ini dapat bermanfaat untuk masyarakat terutama sisi lapangan kerja, CSR dan lainnya serta bermanfaat bagi negara di sektor pajak dan lingkungan. Ini menjadi konsen kami bagaimana sektor pertambangan ini bermanfaat untuk tiga hal tersebut,” paparnya.
Anggota Komisi VII DPR RI, Andi Yuliani Faris berpendapat bahwa bicara tentang pertambangan ilegal bukan hanya sesuatu yang dilakukan masyarakat tanpa izin aaja, tetapi kita juga harus melihat bahwa ada prinsip-prinsip terkait good mining practice. Menurutnya, bisa saja mereka lolos mendapatkan izin tetapi belum tentu mereka mengikuti kaidah yang baik.
“Banyaknya izin-izin pertambangan yang tidak dikelola dengan baik sehingga menimbulkan masalah baru,” jelasnya.
Ia menilai inspektor tambang yang dimiliki saat ini sangat sedikit sekali sehingga ada ketidakmampuan dari pemerintah untuk mengawasi penambang ilegal maupun legal yang tidak melakukan reklamasi atau legal yang masuk kawasan hutan lindung atau legal tetapi tanahnya ditelantarkan sehingga menimbulkan banyak permasalahan.
Sementara itu, Anggota Komisi III DPR RI, H. Santoso mengaku belum melihat adanya grand design dari pemerintah tentang solusi yang komprehensif terhadap persoalan tambang di tanah air. “Menurut saya penegakan hukum tetap harus menjadi prioritas karena dapat membuat efek jera,” pungkasnya. (*)
