PALEMBANG,BeritaTerkini.Co.Id , – Anak di bawah umur berinisial SW (16) ditetapkan tersangka oleh pihak Polres Banyuasin , Peristiwa kecelakaan lalu lintas yang dialaminya pada (14/09/2021) yang lalu. di Kecamatan Tanjung lago, Kabupaten Banyuasin, Sumsel.
Penetapan tersebut, akhirnya memutuskan untuk membawah kasus ini ke ranah Praperadilan, dengan surat Permohonan Praperadilan Nomor 4/Pid.Pra/2022/PN Pkb, antara pihak kuasa hukum SW sebagai Pemohon dan Polres Banyuasin sebagai termohon, sidang digelar di Pengadilan Negeri Pangkalan Balai, Senin (18/04/2022).
Sidang diketuai oleh Majelis Hakim Agewina SH MH dihadiri juga tim kuasa hukum tersangka dan tim kuasa hukum dari Polres Banyuasin.
Kuasa Hukum SW yaitu Ahmad Darmawan SH, Apson Maidi SH, dan Erwan SH, dari kantor hukum AHMAD. dan Rekan, akhirnya resmi dibawa ke ranah Praperadilan karena menurut kaca mata hukum ada yang janggal saat penetapan terduga tersangka yang dijadikan tersangka oleh Polres Banyuasin sejak 22 maret 2022 yang lalu karena kecelakaan lalu lintas.
“Klien kami adalah korban laka lantas tersebut karena saat terjadi kecelakaan klien kami ini memakai sepeda motor sedangkan musuhnya memakai mobil, dari kecelakaan ini sendiri justru klien kami yang banyak mengalami luka dan kerugian, namun entah bagaimana tahu-tahu klien kami dijadikan tersangka oleh Polres Banyuasin, padahal mobil yang menjadi korban kecelakaan dengan klien kami tidak begitu rusak parah,” ucap Darmawan.
Darmawan menegaskan penetapan tersangka terhadap kliennya, di duga tanpa adanya restorative justice (RJ) dan diveris.
Selain itu, dirinya menambahkan pula, disini kita mencari keadilan dan upaya hukum apalagi klien kami ini masih di bawah umur. Kami juga akan membawah kasus ini sampai ke Mabes Polri dan Kompolnas.
“Di sini tidak ada sama sekali perundingan/jalan keluar karena tiba-tiba klien. Kami langsung ditetapkan tersangka tanpa ada proses terlebih dahulu, klien kami sempat menjalani operasi dan rawat jalan kita juga ada bukti Rekam Medisnya,”ungkapnya.
