Wamenkumham : Tak Ada Lagi Perdebatan Terkait RUU PAS, Keputusan MA, PP 99 Justru Memperkuat Kedudukan RUU PAS
Beritaterkini.co.id. Komisi III DPR RI menggelar rapat dengar pendapat dengan KemenkumHAM pada Rabu (25/5).Dalam RDP ini, mereka membahas dua RUU carry over yakni Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) dan RUU Pemasyarakatan (RUU PAS).
Komisi III DPR bersama pemerintah telah mengambil keputusan atas hasil pembahasan Rancangan Undang-Undang Pemasyarakatan (RUU Pas).Komisi III DPR dan pemerintah menyepakati RUU Pas pada tingkat I.
“Jadi sudah tidak ada lagi permasalahan (pembahasan RUU Pas), sehingga tadi untuk RUU Pas itu memang langsung akan diketok,” kata Wakil Menteri Hukum dan HAM (Wamenkumham) Edward OS Hiariej atau Eddy kepada wartawan seusai rapat kerja bersama Komisi III DPR di Kompleks
Parlemen, Senayan, Jakarta, Rabu (25/5/2022).
Eddy mengatakan pembicaraan RUU PAS di parlemen tak ada perdebatan, Eddy menyinggung putusan Mahkamah Agung (MA) yang telah mengabulkan uji materi sejumlah pasal yang mengatur remisi dan pembebasan bersyarat bagi koruptor dalam Peraturan Pemerintah (PP) Nomor 99 Tahun 2012.
Eddy menekankan, tak ada lagi perdebatan terkait RUU PAS. Menurut dia, keputusan Mahkamah Agung terkait PP 99 telah memperkuat kedudukan RUU PAS.
“PAS itu clean and clear karena RUU PAS itu tidak ada perdebatan apa pun. Justru putusan Mahkamah Agung terakhir terkait PP 99 itu memperkuat kedudukannya RUU PAS,” jelas Eddy.
“Jadi ya ini best in the sky, artinya apa yang diputuskan oleh Mahkamah Agung sesungguhnya itu sudah tertuang dalam RUU PAS. Jadi sudah tidak ada lagi permasalahan sehingga tadi untuk RUU PAS itu memang langsung akan diketok,” ucap Eddy.
Menurutnya, putusan MA tersebut telah sesuai dengan yang diatur dalam RUU Pas. “Artinya apa-apa yang diputuskan oleh Mahkamah Agung sesungguhnya itu sudah tertuang dalam RUU PAS,” ucap Eddy.
Untuk diketahui, sebelumnya RUU PAS sempat akan diketuk palu pada 2019 lalu. Namun, saat itu RUU PAS menimbulkan gelombang penolakan dari masyarakat. Presiden Joko Widodo (Jokowi) meminta DPR menunda pengesahan sejumlah RUU, termasuk RUU Pas.
RKUHP dinilai banyak memuat pasal kontroversial. RUU PAS yang bergantung pada RKUHP juga dibatalkan.
Kini, DPR dan pemerintah telah membahas 14 Pasal kontroversial dan menghapus 2 pasal dalam Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP).
Komisi III DPR RI akan menyampaikan surat pemberitahuan tindak lanjut pembahasan RKUHP dan RUU PAS kepada Presiden Jokowi melalui pimpinan DPR.
Eddy menerangkan, setelah melihat hasil provider dari pemerintah, RKUHP dan RUU PAS ditargetkan dapat disahkan pada Juli mendatang.
“Sepertinya akan diselesaikan pada Juli 2022,” pungkas Eddy.
