Palembang,Berita Terkini.Co.Id Sidang perdana gugatan dari Enny Indrianny kepada tergugat Adiono Taslim, Polda Sumsel dan Kejati digelar di Pengadilan Negeri Palembang ,Rabu (14/6/2023).
Usai sidang Enny Indrianny didampingi pengacaranya yaitu Sunaryo, SH.M.H dan Muhammad Saddam Saputra, SH memberikan keterangan kepada awak media.
Sunaryo SH.M.H mengatakan, pada hari ini tanggal 14 Juni 2023 kami ada sidang perdana di mana beberapa waktu yang lalu klien kami ibu Enny telah dinyatakan bebas dengan dua putusan pertama keputusan PN Palembang nomor 1025/Pid.B/2022/PN.Plg yang menyatakan klien kami bebas dari berbagai dakwaan dan KASASI oleh JPU Kejaksaan Tinggi Palembang dan dinyatakan ditolak oleh majelis hakim Agung dalam putusan Mahkamah Agung Nomor 328.K/Pid/2023.
“Berdasarkan putusan itu, hari ini kami mengajukan gugatan perbuatan melawan hukum yaitu yang melaporkan klien kami yaitu Adiono Taslim dan kami menuntut Kapolri Kapolda kemudian kejaksaan Agung CQ Kejaksaan Tinggi, karena kami merasa dalam proses penyidikan atas nama klien kami Ibu Enny ini tidak profesional sehingga diputus bebas. Oleh karena itu kami melakukan tuntutan atau gugatan kepada Adiono Taslim dan dua institusi ,kami minta ganti rugi karena selama klien kami 3 bulan ditahan banyak kerugian klien kami baik materiil dan inmateriil yang dialami oleh klien kami. Kemudian kepada polisi dalam hal ini Kapolda provinsi Sumsel dan Kejaksaan Tinggi Palembang itu materi gugatan kami pada hari ini,” bebernya.
Lebih lanjut, Sunaryo menjelaskan, masalahnya adalah klien kami Bu Enny dituduh atas penipuan dan penggelapan dan akhirnya diproses dan beliau disidang di pengadilan Negeri Palembang dan dinyatakan tidak bersalah karena perbuatan itu ternyata perbuatan perdata bukan pidana.
“Tapi Polisi telah menetapkan tersangka dan ditahan. Kemarin saat ditahan kita mengajukan ditunda dulu proses penyidikannya. Namun polisi dan kejaksaan tidak menghiraukan surat ini. Sehingga masih diproses, hingga klien kami di tahan selama 3 bulan. Jadi beliau sangat menderita di penjara sebagai orang bebas orang merdeka selama 3 bulan ditahan ditahan polisi,” bebernya.
Selama di tahanan, smabung Sunaryo, kliennya ibu Enny mengalami kerugian karena nama baik beliau rusak. Sehingga ada proyek yang tidak jadi kerjasama.
“Jadi beliau minta ganti rugi terhadap Adiono Taslim, Polda Sumsel dan Kejati,” ucapnya.
Sementara itu, Muhammad Saddam Saputra, SH menuturkan, gugatan hari ini awalnya adalah ibu Enny dituduh menipu.
“Padahal itu tidak benar dan ibu Enny perkaranya diadukan bersama Oktariana. Dan Oktariana ini sebelumnya sudah diadukan oleh Bu Enny dan sekarang Oktariana ini dalam menjalani hukuman di Lapas Merdeka,” tuturnya.
Sementara itu, Enny Indrianny mengucapkan terima kasih kepada bapak majelis hakim Pengadilan Negeri Palembang yang telah memutuskan bahwa tuduhan atas diri saya pidana tidak terbukti dan saya telah dibebaskan oleh majelis hakim.
“Di mana tanggal 3 bulan 8 2022 saya ditahan oleh jaksa penuntut umum Kejaksaan Tinggi Palembang jaksa JPU berinsial M Pada hari itu begitu saya di P21 dan saya langsung ditangkap dengan Jaksa M beserta oknum di Polda Sumsel. Saya diperlakukan seperti seorang penjahat seperti seorang penipu besar padahal saya adalah korban dari Oktariana,” katanya.
Enny menjelaskan, Adiono Taslim telah mencairkan bilyet giro sebesar Rp 75 juta. Pada saat saya di BAP saya jelaskan kepada penyidik dan penyidik subdit 2 Harda Polda Sumsel penyidiknya Kompol Suharno dan Yanto di mana satu barang bukti saya bilyet giro yang dicairkan oleh Adiono Taslim dihilangkan.
“Pinjaman kepada Adiono Taslim itu pun bukan saya. Karena saya tidak kenal dengan Adiono Taslim sama sekali. Saya dibawa Oktariana ke showroom Adiono. Bilyet giro yang kosong itu bukan dari saya, dan saya sudah jelaskan kepada pendidik Polda Sumsel berkali-kali tapi mereka tidak menghiraukan kejujuran saya,” bebernya.
Enny menjelaskan, Bilyet Giro bukan dari pihak saya. Dari pihak saksi sebelah saya belum di BAP oleh penyidik tapi sudah di P21 kan oleh Jaksa Penuntut Umum di situ saya melihat oknum di Polda Sumsel dan oknum kejaksaan memihak kepada pihak Adiono Taslim.
“Sekarang saya minta keadilan untuk diri saya. Saya ditahan di Polda di Tahti Polda Sumsel seperti seorang penjahat ditempatkan di ruang gelap, ruang pengap. Sekarang saya menggugat dan akan melapor balik pihak Adiono Taslim,” tandasnya.
Enny meminta kepada awak media untuk terus mengawal perkara ini. Sehingga pekara ini menjadi akuntabilitas dan transparan baik pekara yang saat ini sedang diajukan Kasasi ataupun pekara yang saat ini sedang berlangsung di Pengadilan Negeri Palembang.
Untuk diketahui, Enny Indrianny beberapa hari kedepan akan melaporkan balik Adiono Taslim ke pihak kepolisian. (RZP)
