Gerudug MDA Bali, Warga Desa Adat Ungasan Serahkan Surat Nota Keberatan Atas Tahapan Ngadegang Kelian Desa Adat Ungasan
DENPASAR, beritaterkini.co.id | Sejumlah Warga Desa Adat Ungasan, Kecamatan Kuta Selatan, Kabupaten Badung mendatangi Kantor Majelis Desa Adat atau MDA Provinsi Bali dengan menyerahkan Surat Nota Keberatan ke Kantor Majelis Desa Adat atau MDA Provinsi Bali, Denpasar, Selasa, 27 Juni 2023.
Melalui Surat Nota Keberatan, mereka menuntut keadilan agar tahapan Ngadegang Kelian Desa Adat dan Prajuru Desa Adat Ungasan tahun 2023 dilakukan melalui proses Pemilihan atau Penyudian Krama Desa Adat lantaran sesuai tahapan yang disampaikan oleh Panitia/Prawartaka, maka dilanjutkan tahapan Pemilihan langsung oleh Krama Desa Adat Ungasan, pada 25 Juni 2023.
Salah satu Tokoh Masyarakat Desa Adat Ungasan, Made Windra mengatakan Surat Nota Keberatan tersebut ditandatangani 1.494 Warga Desa Adat Ungasan, karena rangkaian tahapan tersebut dinilai tidak berjalan sesuai dengan proses demokrasi, baik saat dimulainya tahapan penjaringan calon maupun proses tahapan musyawarah, pada 18 Juni 2023.
“Saat kami berada di Kantor MDA Bali, kami tidak diizinkan masuk ke Ruang Rapat yang disitu telah ada Panitia/Prawartaka Ngadegang Kelian Desa Adat dan Prajuru Desa Adat Ungasan. Demikian pula, wartawan tidak boleh masuk. Entah apa hasilnya, saya belum mendapat kabar,” ungkapnya.
Menyikapi hal tersebut, Made Windra menyebutkan Panitia/Prawartaka Ngadegang Kelian Desa Adat dan Prajuru Desa Adat diduga telah melakukan kebohongan publik, karena pada saat melakukan sosialisasi tahapan di masing-masing Banjar Adat sudah disampaikan akan digelar tahapan Pemilihan atau Penyudian oleh Krama Desa Adat, jika calon tidak mencapai musyawarah mufakat. Namun, hal tersebut tidak dilaksanakan malah justru memohon arahan dan pertimbangan ke Majelis Desa Adat atau MDA Provinsi Bali.
“Kami melihat fenomena apa yang terjadi, didalam proses tahapan ini merasa kurang pas, karena sesuai dengan sosialisasi awal dari pihak Panitia/Prawartaka yang disampaikan ke masing-masing banjar itu, ada sejumlah tahapan-tahapan yang harus dilakukan,” jelasnya.
Namun, lanjutnya, tindakan sepihak Panitia/Prawartaka Ngadegang Kelian Desa Adat dan Prajuru Desa Adat yang membuat keputusan pada 23 Juni 2023 jelas-jelas akan memperlambat proses tahapan Ngadegang Kelian Desa Adat dan Prajuru Desa Adat Ungasan.
“Dalam proses tahapan ini tidak tercapai musyawarah mufakat, maka seharusnya keinginan masyarakat harusnya dilanjutkan Pemilihan/Penyudian Pesuaran Krama artinya Pemilihan oleh Krama Desa Adat Ungasan, namun hal itu tidak dilakukan Panitia,” paparnya.
Oleh karena itu, pihaknya mempunyai kewajiban untuk menjaga keamanan, ketertiban dan kenyamanan dalam menentukan nasib serta arah Desa Adat Ungasan kedepan, agar terlaksana dengan demokrasi hak individu Krama Desa Adat untuk memilih dan dipilih sebagai Kelian Desa Adat dan Prajuru Desa Adat.
“Maka, kami Krama Desa Adat Ungasan menuntut agar dikembalikan Marwah Desa Adat ke Awig-Awig Desa Adat Ngadegang Kelian Desa adat melalui Pemilihan Krama. Kemudian, kami juga menolak keputusan Rapat Panitia, khususnya poin ke-2 sesuai bukti Berita Acara Rapat terlampir, Jumat, 23 Juni 2023. Jika tahapan tidak dilanjutkan sesuai dengan yang telah disosialisasikan oleh panitia sebelumnya, kami menuntut dilakukan pembatalan semua proses yang telah berjalan sebelumnya dan Panitia/Prawartaka dibubarkan, diganti atau dibentuk panitia baru yang lebih independen, netral atau tidak memihak salah satu calon Kelian Desa Adat Ungasan,” paparnya.
Patut diketahui, sebelumnya, proses tahapan-tahapan Ngadegang Kelian Desa Adat dan Prajuru Desa Adat Ungasan telah dilakukan oleh Panitia/ Prawartaka Ngadegang Kelian Desa Adat.
Menariknya, hingga tahapan terakhir dihadiri oleh para Calon Kelian Desa Adat Ungasan, Prajuru Desa Adat Ungasan, Kelian Banjar Adat se-Desa Adat Ungasan, Kertha Desa Adat Ungasan dan Sabha Desa Adat Ungasan, yang bertempat di Wantilan Dirga Laba Ungasan, pada 18 Juni 2023.
Meski demikian, keputusan rapat terakhir Panitia/ Prawartaka Ngadegang Kelian Desa Adat malah dead lock atau tidak mencapai kesepakatan musyawarah mufakat.
Padahal, sesuai tahapan yang telah disosialisasikan ke masyarakat seharusnya dilakukan tahapan selanjutnya, yakni Pemilihan atau Penyudian Krama. Namun, Panitia/ Prawartaka Ngadegang Kelian Desa Adat malah memutuskan untuk memohon arahan dari Majelis Desa Adat atau MDA Provinsi Bali.
“Jadi, hal ini membuat masyarakat bingung, karena pada saat sosialisasi tahapan tata cara Ngadegang Kelian Desa Adat oleh Panitia/Prawartaka Ngadegang Kelian Desa Adat jelas-jelas disampaikan kepada krama di masing-masing banjar, apabila tidak terjadi kesepakatan antara Calon Kelian Desa Adat maupun Lembaga Pengambil Keputusan akan dilanjutkan dengan Pemilihan atau Penyudian oleh Krama Desa Adat sesuai dengan jadwal dan tahapan-tahapannya,” terangnya.
Disebutkan, sesuai Perarem Tata Cara Ngadegang Kelian Desa Adat dan Prajuru Desa Adat Ungasan Nomor 01 tahun 2023 yang sudah ditetapkan dan ditandatangani adalah bukan sepenuhnya dari hasil musyawarah lembaga, prajuru dan tokoh masyarakat, yang pada saat pembahasan revisi perarem hanya menitikberatkan kepada persyaratan Calon Kelian Desa Adat.
“Karena ada poin-poin yang tidak dimasukkan dan dihilangkan, yaitu tidak menjadi pengurus partai politik sesuai Pasal 7 Perarem Desa Adat Ungasan Nomor 1 tahun 2023 dan tidak ada menyentuh draft Pasal 19 yang terdiri dari 8 Ayat, karena sudah disepakati semuanya,” paparnya.
Namun, tanpa sepengetahuan dan persetujuan peserta rapat yang diajak pada saat rapat revisi perarem, lanjutnya, Pasal 19 pada perarem Ngadegang Kelian Desa Adat berubah, yang mana Pasal 19 hanya sampai Ayat 6. Sedangkan, dalam draft yang telah disepakati, Pasal 19 berisi 7 Ayat dan 8 yang intinya menyebutkan ketika tidak tercapai kesepakatan musyawarah mufakat, haruslah tahapan berikutnya dilanjutkan dengan tahapan Penyudian/Pesuaran atau Pemilihan secara langsung oleh Krama Desa Adat Ungasan.
“Nah, disitu ada Pasal 19 yang Ayat 7 dan 8 ini dihilangkan dan tidak dimasukkan kedalam Perarem yang disahkan atau ditandatangani. Selain itu, lampiran Berita Acara Rapat yang dilampirkan didalam Perarem Nomor 1 tahun 2023 berupa Berita Acara Rapat No. 003/BA-DAU/I/2023 yang hanya dihadiri oleh 17 orang peserta adalah salah atau tidak benar yang seharusnya lampirannya adalah rapat pada saat pembahasan revisi draft yang sudah menjadi keputusan rapat,” tegasnya.
Kemudian, Panitia/Prawartaka Ngadegang Kelian Desa Adat dan Prajuru Desa Adat Ungasan melakukan rapat yang menghasilkan tiga keputusan di Ruang Pertemuan LPD Desa Adat Ungasan, Jumat, 23 Juni 2023.
“Kami selaku masyarakat Desa Adat Ungasan merasa keberatan atas hal itu dan tidak seharusnya terjadi di Desa Adat kami. Kami hanya menginginkan, kalau memang tidak tercapai musyawarah mufakat, seharusnya lanjutkan saja ke tahapan Pemilihan Pesuaran Krama. Itu saja, yang lain-lain itu tidak. Kami tidak ingin punya seorang pemimpin yang tanpa melalui proses tahapan yang demokrasi. Kami hanya inginkan hak masyarakat itu terpenuhi,” pungkasnya.
