Palembang ,Berita Terkini.Co.Id. Meminta membatalkan Permendagri Nomor 134 Tahun 2022 Advokat Sofhuan Yusfiansyah SH akan mengajukan Gugatan Ke Mahkamah Agung pada hari ini, mendaftarkan atau meregister gugatan ke MA,Senin 31 Juli 2023.
Hal ini seperti yang disampaikan oleh
Sofhuan Senin tanggal 31 Juli 2023 pihaknya berangkat ke Mahkamah Agung untuk mengajukan gugatan.ungkap
“Draf gugatan sudah final, kami meminta Mahkamah Agung untuk membatalkan Permendagri nomor 134 tahun 2002 tentang Tapal Batas untuk Banyuasin dan Kota Palembang. Intinya adalah di dalam aturan tersebut banyak merugikan pihak-pihak terutama kepentingan publik banyak hal terkait soal domisili, mata pilih,TPS nya.
Kemudian belum lagi Pemkot Palembang PBB-nya atau asetnya kota Palembang yang tadinya di kota Palembang ketika pindah kabupaten maka turunlah nilai asetnya tersebut.Karena banyak macam kepentingan publik di sana, ujarnya.
“Belum lagi persoalan jarak tempuh kalau masyarakat yang berada di daerah perbatasan sudah pasti dirugikan misalnya masyarakat yang berdomisili di daerah Tegal Binangun ketika akan mengurus administrasi tertentu harus menuju ke pangkalan balai atau dari Jakabaring ke pangkalan balai dengan jarak tempuh yang cukup jauh dengan rentang waktu 2 jam sampai 3 jam,” tambahnya.
Lebih lanjut Sofhuan mengatakan, Kalau Pemkot Palembang sudah barang tentu mengalami banyak kerugian.
“Maka harapan kita dengan trigger kita ini Pemkot Palembang juga harus mengajukan judisial review. Karena beberapa daerah pada saat kita cek di Google beberapa wilayah Pemkab pemkot di daerah lain juga melakukan judicial review,” katanya.
Kalau pemerintah kota Palembang sudah pasti dirugikan,kalau kami terus terang saja mewakili kepentingan rakyat dan masyarakat langsung yang terdampak dan merasa dirugikan dengan adanya aturan tersebut ya kita mengungkapkan besok kepada Mahkamah Agung terkait uraian-uraian yang berhubungan dengan kepentingan publik yang merasa dirugikan dan itu detail poin-poinnya apa saja dan itu belum kita sampaikan di sini.
Tapi drafnya sudah siap dan sudah fix dan kami tanda tangan semua melengkapi berkas termasuk juga menyerahkan barang bukti kami ke Mahkamah Agung.
Kami akan melakukan register karena kita harapkan langsung judicial review permohonan uji material ke Mahkamah Agung.
Harapan kami semoga saja dapat dikabulkan oleh Mahkamah Agung terkait permohonan uji materiil ini supaya Permendagri Nomor 134 tahun 2022 dapat dibatalkan,” tegasnya.
