Narkotika Terbaru Dijelaskan BNN ke Mahasiswa Hukum Jayabaya

Beritaterkini Jakarta – Dalam rangka pengembangan proses belajar dan mengajar Fakultas Hukum (FH) Universitas Jayabaya mengirimkan surat ke Kepala Badan Narkotika Nasional (BNN) sebagaimana surat Nomor ; 377/Dek/FH-UJ/XI/2021 tertanggal 18 Nopember 2021, perihal penelitian terkait tembakau gorila.

Selanjutnya pada Senin, (29/11/2021) sebanyak 12 perwakilan Mahasiswa didampingi Ketua Unit Penelitian Pengabdian Masyarakat dan Publikasi (UP2P) Fakultas Hukum Universitas Jayabaya, Hj. Sheha A. Habib, SH.MH diterima kedatangannya oleh Kepala Pusat Penelitian Data dan Informasi (Puslitdatin) BNN, Brigjen (Pol) Drs. Agus Rianto SH.

Dalam audiensi dan diskusi yang berlangsung di Kantor BNN, Jalan MT. Haryono, Jakarta Timur dibahas terkait penelitian terhadap aspek hukum pengguna dan pengedar tembakau gorila. “Kami mendapat penjelasan dan paparan yang disampaikan oleh Bapak Brigadir Jenderal Polisi Drs Agus Irianto SH, M.Si, Ph.d, di mana beliau menyampaikan beberapa hal tentang jenis narkotika, diantaranya Candu (papaver somniverum) yang bersumber dari Golden Crescent (Afghanistan, Iran, dan Pakistan) Golden Triangle atau yang lebih dikenal sekarang sebagai Delta Mekong (Myanmar, Laos, dan Vietnam), Kokain berasal dari Golden Peacock Kolombia,” ujar Sheha A. Habib kepada media ini, Selasa (14/12/2021).

Dari penjelasan dalam diskusi diungkapkan Sheha, perkembangan zaman, telah mendorong terjadinya perubahan produksi candu menjadi produksi sabu.

“Dalam perkembangannya narkotika dari jenis alami, bergeser ke narkotika semi sintetik dan sintetik, di mana Indonesia pun fokus melakukan penelitian narkotika jenis semi sintetik atau sintetik, sehingga dalam setiap tahunnya BNN untuk atas nama Indonesia menghadiri Asean Senior on Drugs (ASoD) yang terbagi menjadi beberapa kelompok kerja, antara lain Pemberantasan, Pemberdayaan Masyarakat, Pencegahan, Rehabilitasi, dan Riset,” jelas Sheha.

Meniru penjelasan Brigjen (Pol) Agus, Sheha mengatakan, tembakau gorila adalah merupakan narkotika jenis semi sintetik dan sintetik, sedangkan kadar narkotikanya tergantung dari zat narkotika yang dicampurkan ke dalam tembakau gorila tersebut yang pada umumnya dapat menimbulkan efek halusinasi, rasa senang yang berlebihan dan pastinya ketergantungan (adiktif), pada beberapa orang yang tidak kuat menahan efek tersebut dapat mengalami muntah-muntah hingga black out (pingsan), hal ini serupa dengan pengguna narkotika jenis ganja sintetik.

Pola peredaran atau penjualan tembakau gorila dilakukan secara sembunyi-sembunyi dengan cara dari mulut ke mulut atau media sosial, di mana tembakau gorila dikalangan pengedar dan pemakai menggunakan beberapa nama sebagai bahasa sandi diantaranya, Hanoman, Natareja atau Sun Go Kong dan lainnya, serta dengan beragam harga antara puluhan ribu rupiah hingga ratusan ribu rupiah tergantung jenis serta ukuran berat dan kandungan narkotika sintetis yang digunakan.

Sheha menambahkan bahwa dalam lampiran Undang-Undang No.35 Tahun 2009 Tentang Narkotika memang tidak disebutkan dengan jelas mengenai tembakau gorila, namun zat narkotika yang biasa digunakan dalam tembakau gorila dimuat dalam Peraturan Menteri Kesehatan No. 4 Tahun 2021 Tentang Perubahan Golongan Narkotika (Selanjutnya disebut Permenkes), karena kandungan tembakau gorila yang pada prakteknya disamakan dengan ganja sintetik dan memiliki efek yang sama, sehingga tembakau gorila dapat dikategorikan masuk ke dalam narkotika golongan I, sehingga penegak hukum terhadap pengedar dan atau pengguna tembakau gorila dengan dasar Undang- Undang No.35 Tahun 2009 Tentang Narkotika Jo. Peraturan Menteri Kesehatan No. 4 Tahun 2021 Tentang Perubahan Golongan Narkotika yang memasukkan zat narkotika tembakau gorila ke dalam narkotika golongan I.

Namun pada prakteknya dalam penanganan tembakau gorila sedikit mengalami kerancuan mengenai pengukuran berat, yang menjadi rancu apakah yang diukur adalah berat sari tembakaunya atau kandungan dari zat kimia tembakau gorila, karena dalam proses pembuatan tembakau gorila biasanya ialah tembakau sintesis ini direndam atau disemprotkan zat kimia narkotika.
