Demo Kejagung, Ribuan Massa KOMPAK Tuntut Novel Baswedan Segera Diadili

JAKARTA – BERITATERKINI.co.id – Seribuan massa yang tergabung dalam Koalisi Masyarakat Penegak Keadilan (KOMPAK) meminta agar penyidik KPK, Novel Baswedan segera diadili dalam kasus penganiayaan dan pembunuhan tehradap terduga pelaku pencurian sarang burung walet di Bengkulu pada tahun 2004 silam.

Seruan dan desakan itu disampaikan dalam aksi demonstrasi di depan gedung Kejaksaan Agung (Kejagung) pada Sabtu siang, (28/12/2019). Mereka juga membawa sejumlah poster berisi desakan agar Novel Baswedan segera ditangkap dan diadili.

 

Ketua KOMPAK, Asep Irama curiga, kasus hukum yang menjerat Novel sengaja tidak dilanjutkan demi menyelamatkan eks Kasat Reskrim Polres Bengkulu itu yang kini dipuja-puja bak pahlawan di KPK.

“Selebihnya, Novel tak lebih dari pelaku kejahatan dengan cara sadis, dimana korban ditembak dan bahkan ada yang meregang nyawa karena aksi keji Novel Baswedan,” teriak Asep dari atas mobil komando.

Bahkan ujar Asep, Kejaksaan ikut menyatakan berkas perkara Novel Baswedan yang dilimpahkan dari hasil penyelidikan kepolisian sudah dinyatakan P-21 baik dari segi pembuktian, locus serta tempus. Berkas perkara kemudian dilimpahkan ke Pengadilan Negeri Bengkulu tanggal 29 Januari 2016 lalu.

Asep menambahkan, tiba-tiba JPU menarik kembali surat tuntuan pada tanggal 2 Febriari 2016 dengan alasan mau disempurnakan.

Anehnya kata dia, Kejaksaan tiba-tiba mengeluarkan Surat Ketetapan Penghentian Penuntutan (SKPP) Nomor B-03/N.7.10/Ep.1/02/2016, yang ditandatangani Kepala Kejaksaan Negeri Bengkulu.

“Kejaksaan berdalih jika kasus Novel Baswedan tidak cukup bukti dan kasusnya sudah kadaluarsa,” sesal alumnus Fakultas Hukum Universitas Bung Karno (UBK) Jakarta tersebut.

Bahkan, hakim tunggal Suparman dalam putusan Praperadilan menyatakan Surat Ketetapan Penghentian Penuntutan (SKPP) Kepala Kejaksaan Negeri Bengkulu terhadap Novel Baswedan tidak sah. Hakim menyatakan SKPP tersebut tidak mempunyai kekuatan hukum mengikat.

Keputusan tersebut diambil setelah menimbang berbagai bukti-bukti yang diungkap di persidangan.

Dalam putusannya, hakim juga memerintahkan kepada termohon agar menyerahkan berkas perkara Novel Baswedan kepada Pengadilan Negeri Bengkulu dan melanjutkan penuntutan perkara tersebut dalam pelaksanaan persidangan.

“Wajar jika publik curiga, bahwa KPK menyimpan sejumlah rahasia eks Jaksa Agung, HM Prasetyo sehingga tidak berani melimpahkan berkas perkara Novel Baswedan ke PN Bengkulu untuk disidangkan,” sambung Asep.

Kejaksaan Lecehkan Pengadilan

Bagi Asep, Kejaksaan sudah menunjukkan sikap melindungi penjahat kemanusiaan dan membangkang perintah Pengadilan.

“Aksi cuci tangan Kejaksaan dalam perkara pembunuhan yang disangkakan kepada Novel Baswedan terus mengusik nurani publik. Bisa jadi ini sebagai pembenaran bahwa ‘hukum hanya tajam ke bawah, tapi tumpul ke atas’,” kata Asep.

Asep memandang, Kejaksaan tidak saja mengkangkangi putusan Pengadilan, tapi juga melecehkan Konstitusi.

“Olah karena itu, demi martabat, kehormatan dan masa depan penegakan hukum, tangkap dan adili Novel Baswedan. Tidak boleh ada yang kebal hukum di negeri ini,” demikian tandas Asep.
