Panja RUU Minerba DPR Lalai, DPD Tidak Dilibatkan Dalam Pembahasan DIM

JAKARTA, BERITATERKINI.CO.ID | Komisi VII DPR RI akhirnya menunda rapat kerja dengan Pemerintah yang diagendakan tanggal 8 April 2020 untuk Pembicaraan/Pengambilan Keputusan Tingkat I atas Rancangan Undang-Undang tentang Perubahan atas UU Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara (RUU Minerba), hal ini sesuai surat Menteri ESDM tgl 3 April 2020 untuk menunda rapat kerja karena penanganan Covid-19 dan pemerintah masih perlu koordinasi antar kementerian yang dikoordinasikan oleh Menko Perekonomian.

Penundaan rapat kerja ini merupakan respon tuntutan berbagai kalangan agar pembahasan RUU Minerba dihentikan karena cacat hukum, seperti diketahui pada tanggal 3 April, berbagai kelompok masyarakat dan stakeholder pertambangan ramai-ramai menuntut agar pembahasan RUU Minerba dihentikan, termasuk oleh Koalisi Masyarakat Peduli Minerba (KMPM) yang menyampaikan Surat Terbuka ditujukan kepada Presiden RI dan Pimpinan DPR RI.

KMPM terdiri dari kelompok masyarakat dan ahli pertambangan Indonesia, antara lain Sonny Keraf tokoh senior yang juga mantan Ketua Panja RUU Minerba tahun 2005-2009, Simon Sembiring Mantan Dirjen Minerba saat itu sebagai Wakil Pemerintah dalam pembahasan RUU Minerba tahun 2005-2009, Ryad Chairil Ketua The Centre for Energy and Resources Law, Ahmad Redi Direktur Kolegium Jurist Institute, Marwan Batubara Direktur Indonesia Resources Studies, Lukman Malanuang Direktur Lembaga Kajian Energi, Pertambangan, dan Industri Strategis, Milawarma ahli dan praktisi Pertambangan Indonesia, Budi Santoso dari Centre For Indonesian Resources Strategic Studies, Djowamen Purba ahli Pertambangan Indonesia, serta Yusri Usman Direktur Center of Energy and Resources Indonesia menilai apabila DPR dan Pemerintah tetap melanjutkan pengambilan keputusan atas RUU Minerba maka telah nyata melakukan pelanggaran hukum, pelanggaran konstitusi, dan pelanggaran etik.

Hal ini karena seluruh Pembahasan RUU Minerba oleh DPR dan Pemerintah dilakukan secara tertutup dan tidak dilakukan di gedung DPR serta tidak melibatkan partisipasi publik, bahkan naskah RUU Minerba hasil pembahasan dirahasiakan tidak bisa diakses oleh publik. Selain itu tidak ada konsultasi publik terhadap materi RUU Minerba, yang lebih fatal Pembahasan RUU Minerba ini tidak melibatkan Dewan Perwakilan Daerah (DPD RI), padahal berdasarkan Pasal 22D UUD Negara RI Tahun 1945 dan Pasal 249 UU Nomor 17 Tahun 2014 tentang MPR, DPR, DPD, dan DPRD serta Putusan Mahkamah Kontitusi Nomor 92/PUU-X/2012 menegaskan bahwa DPD mempunyai kewenangan membahas RUU Minerba karena merupakan rancangan undang-undang yang berkaitan dengan hubungan pusat dan daerah serta pengelolaan sumber daya alam dan sumber daya ekonomi lainnya.

Anehnya Pimpinan DPR RI baru belakangan mengundang Pimpinan DPD RI untuk membahas RUU Minerba, yaitu sesuai surat tertanggal 16 Maret 2020 yang tercatat baru diterima di sekretariat DPD tgl 1 April 2020, padahal pembahasan 923 DIM ( Daftar Inventarisasi Masalah ) sudah selesai sekitar awal Maret 2020.

Menanggapi penundaan rapat kerja oleh Komisi VII DPR dan Pemerintah, Yusri Usman juru bicara KMPM menyampaikan bahwa pembahasan RUU Minerba tidak cukup hanya ditunda tetapi harus dihentikan. Kalaupun ditunda dan akan dilanjutkan lagi harus melalui proses dan tahapan pembahasan yang benar sesuai dengan Undang-Undang dan Konstitusi UUD Negara RI Tahun 1945. Penundaan ini tidak cukup dua minggu atau dua bulan tetapi harus dalam waktu yang cukup untuk melakukan pembahasan RUU Minerba dengan benar dan melibatkan partisipasi publik secara langsung. “Sebaiknya saat ini DPR dan Pemerintah mempublikasikan naskah RUU Minerba ke publik, agar dapat dinilai dan diberikan masukan oleh masyarakat, RUU Minerba ini bukan barang rahasia yang harus ditutup-tutupi oleh DPR dan Pemerintah, apalagi dengan langkah main sembunyi-sembunyi”, ujar Yusri Usman di Jakarta (07/04/2020).

Lebih lanjut, Yusri Usman menambahkan waktu yang ada saat ini perlu dimanfaatkan untuk menghimpun aspirasi dari masyarakat dan stakeholder serta memperbaiki materi-materi substansi RUU Minerba agar tetap sesuai dengan amanat konstitusi yaitu penguasaan negara atas sumber daya alam pertambangan yang untuk kepentingan sebesar-besarnya kemakmuran rakyat.

DPR dan Pemerintah ditengah-tengah kondisi darurat karena wabah Covid-19 jangan coba-coba mengelabuhi masyarakat dan memaksakan pengambilan keputusan atas RUU Minerba, risikonya besar. Baik risiko bagi tata kelola pertambangan maupun risiko bagi Anggota DPR dan Pemerintah karena telah melanggar hukum. Apabila RUU Minerba dipaksakan lanjut mengambil keputusan, maka KMPM akan melaporkan secara hukum dan membawa ke Majelis Kehormatan Dewan (MKD) karena secara sadar sebagai anggota DPR telah melanggar konstitusi UUD Negara RI Tahun 1945, UU MD3, UU Pembentukan Peraturan Perundang-Undangan, dan Tata Tertib DPR RI, termasuk juga akan mengajukan jucial review ke Mahkamah Konstitusi jika sudah diundangkan. /Yusri/beritaterkini
