Pada hari ini tanggal 21 Oktober 2020 kami dari Law Firm Togar Situmorang hadir di Pengadilan Negeri Singaraja selaku kuasa hukum dari klien Terdakwa dalam dugaan tindak pidana pencemaran nama baik.
Adapun agenda hari ini adalah pemeriksaan tiga orang saksi dari Jaksa Penuntut Umum.
Jadi untuk saksi yang pertama kita tidak terlalu mengikuti namun kita fokus pada saksi kedua dan ketiga.

Untuk keterangan saksi yang kedua menyatakan bahwa pada saat dilaksanakan Paruman Desa di Desa Gunung Sari Buleleng itu Pelapor pada saat itu berdiri sambil menunjukkan sertifikat serta saksi kedua tersebut menyatakan bahwa klien kami mengatakan kata-kata penipu, sertifikat palsu.
Padahal klien kami dilihat tanpa ekspresi tidak ada menunjuk ke siapa, arogansi dan tidak ada kata-kata menghina kepada Pelapor dan tidak ada penjabaran secara spesifik kepada siapa diarahkan.
Togar Situmorang juga menambahkan jika kita berbicara pencemaran nama baik tentunya harus ada hubungan kausalitas atau hubungan hukum sebab akibat.
Sementara klien kami tidak ada menyebutkan nama Astawa dan ternyata nama Astawa dalam paruman tersebut banyak jumlahnya. Dan adapun niat dari klien kami hanyalah sebuah edukasi terhadap masyarakat mengenai sertifikat tersebut.

Dan terungkap juga fakta dipersidangan bahwa diantara keduanya sudah terjadi perdamaian serta menjadi pertanyaan kami kenapa sudah terjadi perdamaian namun tetap dilanjutkan juga kasus ini? kami menilai kasus ini sungguh sangat dipaksakan dan karena ini merupakan delik aduan jadi seharusnya laporannya dari awal sudah bisa dihentikan.
Melihat fakta tersebut seharusnya putusan terhadap perkara ini adalah mendapat putusan bebas.
Karena murni tidak ada niat dari klien kami mencederain kehormatan nama baik seseorang.
