125 Kepala Kampung Diberhentikan Sepihak, BPI KPNPA RI Minta Bupati Puncak Jaya Dinonaktifkan

JAKARTA – BERITATERKINI.co.id – Ketua Umum Badan Peneliti Independen Kekayaan Penyelenggara Negara dan Pengawas Anggaran Republik Indonesia (BPI KPNPA RI), Tubagus Rahmad Sukendar mengaku akan terus mengawal kasus pemberhentian ratusan Kepala Kampung di Kabupaten Puncak Jaya, Papua oleh Bupati Puncak Jaya, Yuni Wonda.

Sebelumnya, 125 Kepala Kampung diberhentikan secara sepihak oleh Yuni Wonda melalui Keputusan Bupati Puncak Jaya nomor 188.45/95/KPTS/2018 tertanggal 22 Juni 2018.

Sukendar bersama salah satu anggota DPRD Puncak Jaya, Mendis Wonda Gire akan menemui Menteri Dalam Negeri (Mendagri), Tito Karnavian dan Kapolri Jenderal Idham Azis di Jakarta untuk membicarakan dan mengadukan masalah ini.

BPI KPNPA RI juga sudah mengirimkan surat kepada Presiden Joko Widodo dengan Nomor: 027/DPN-BPI/II/2019 tertanggal 15 Februari 2019 tentang tentang dugaan pelanggaran terhadap UU Nomor 6 Tahun 2014 Tentang SK Bupati Puncak Jaya soal pemberhentian 125 kepala kampung.

“SK Bupati Puncak Wijaya kan sejak awal memang diskriminatif. Sebab, ratusan kepala kampung diberhentikan secara sepihak dan tidak prosedural. Sehingga kita akan kawal masalah ini sampai selesai. Karena SK Bupati berpotensi mengakibatkan perang suku,” kata Sukendar di Mabes Polri, Senin, (02/12/2019).

Ia memuji sikap ratusan kepala kampung yang memilih menempuh jalur hukum dalam melawan keputusan bupati yang sewenang-wenang.

“Ini sejarah baru yang patut diapresiasi. Seperti yang diketahui, selama ini mayoritas masyarakat di Papua memilih perang suku, dan mereka warga Puncak Jaya memilih jalur hukum karena awalnya sempat terjadi peperangan suku yang menimbulkan banyak korban jiwa,” tegas Sukendar.

Sukendar juga meminta agar Kemendagri menonaktifkan Bupati Puncak Jaya yang tidak mau melaksanakan putusan Mahkamah Agung (MA), yang memerintahkan agar 125 Kepala Kampung dikembalikan kepada jabatannya semula, sekaligus mencabut SK Bupati Puncak Jaya tentang pemberhentian mereka.

“Karena Bupati Puncak Jaya tidak melaksanakan keputusan Pengadilan, maka kita minta agar untuk sementara Bupati dononaktifkan dari jabatannya sampai masalah ini selesai,” tandas Sukendar.

Sementara itu, Mendis Wonda Gire mengatakan jika dirinya sengaja datang ke Jakarta untuk memperjuangkan nasib 125 Kepala Kampung yang jadi korban kesewenang-wenangan Bupati Puncak Jaya.

“Karena sedianya jabatan mereka sampai tahun 2021 mendatang. Tapi tiba-tiba mereka diberhentikan secara sepihak tanpa alasan yang bisa dipertanggung jawabkan secara hukum.”

“Maka kita akan adukan masalah ini Kemendagri dan Polri. Apalagi perintah Pengadilan mulai dari PTUN, PTTUN dan MA, memerintahkan agar mereka dikembalikan kepada jabatannya,” terang dia.

Ia juga berterima kasih kepada BPI KPNPA RI yang ikut serta untuk memberikan pendampingan kepada mereka, terutama dalam membantu memfasilitasi bertemu dengan Mendagri dan Polri.

“Mudah-mudahan segera ada titik terang dan Bupati Puncak Jaya patuh kepada UU dan putusan Pengadilan,” tandas dia.

Sebelumnya, 125 Kepala Kampung mengajukan gugatan ke Pengadilan Tata Usaha Negara (PTUN) Jayapura. Majelis Hakim PTUN Jayapura mengabulkan permohonan para penggugat dan memerintahkan Bupati Puncak Jaya mencabut Keputusan Bupati Puncak Jaya.

Namun Bupati menolak keputusan tersebut. Bupati kemudian mengajukan banding ke Pengadilan Tinggi Tata Usaha Negara (PTTUN) Makassar. Namun, putusan PTTUN Makassar menguatkan putusan PTUN Jayapura sebelumnya.

Tergugat selanjutnya mangajukan Kasasi ke Mahkamah Agung (MA). Namun MA melalui putusan Nomor 367/K/Tun/2019 tertanggal 26 September 2019 menolak permohonan kasasi tergugat.
