JAKARTA – BERITATERKINI.co.id – Menteri Koordinator Bidang Politik Hukum dan Keamanan, Mahfud MD mengatakan bahwa sejak pemerintahan Presiden Joko Widodo di tahun 2014 lalu tidak ada satupun pelanggaran HAM.
“Coba lihat di era Pak Jokowi, sejak 2014 sampai sekarang tidak ada satu pun isu pelanggaran HAM,” ucap Mahfud di Kantor Menko Polhukam, Jakarta Pusat, Kamis (12/12/2019).
Menurut Mahfud, pelanggaran HAM berbeda dengan kejahatan kriminal.
“Pelanggaran HAM by law menurut definisi hukum adalah pelanggaran yang dilakukan oleh aparat pemerintah dengan terencana dan dengan tujuan tertentu. Itu pelanggaran HAM,” tuturnya.
“Kalau misalnya tentara ngamuk karena istrinya diselingkuhi, itu bukan pelanggaran HAM. Itu kriminal, dan itu banyak. Ada juga polisi diamuk oleh rakyat, itu bukan pelanggaran HAM. Ada rakyat ngamuk ke rakyat, itu bukan pelanggaran HAM. Itu yang sifatnya horizontal itu kejahatan namanya kerusuhan,” imbuh Mahfud.
Bahkan dalam peristiwa kerusuhan tanggal 21-22 Mei lalu yang mengakibatkan beberapa orang meninggal dunia bukan pelanggaran HAM.
“Yang 22 Mei jangan bilang pelanggaran HAM, kalau itu justru polisi yang diserang kan? Anda tahu kan sudah ada videonya, sudah tahu polisi diam terus dilempar, diajak berkelahi,” ucap mantan ketua MK itu.
“Ini bukan pelanggaran HAM yang terencana mereka yang menyerang. nanti kita lihat pengadilan. Pengadilan yang masih berjalan sudah dibilang pelanggaran HAM itu dulu deh saya mau ada tamu,” tambah Mahfud.
Menurutnya, hingga saat ini setidaknya ada 11 kasus HAM yang masih menjadi tanggungan negara untuk diungkap yang keseluruhannya terjadi sebelum pemerintahan era Jokowi.
“Masih ada 11 kasus di Indonesia berdasar hasil yang diolah di sini baik dari Komnas HAM maupun kita dan dalam 11 kasus itu semuanya terjadi jauh sebelum Pak Jokowi,” beber Mahfud.
11 kasus pelanggaran HAM yang dimaksud Mahfud itu yakni penculikan dan penghilangan orang secara paksa 1997-1998, tragedi Semanggi I dan II 1998-1999, tragedi Simpang Kertas Kraft Aceh 1999, peristiwa Wasior 2001, kasus Wamena 2003, tragedi Jambu Keupok Aceh 2003, peristiwa 1965-1966, penembakan misterius 1982-1986, pembantaian Talangsari 1989, tragedi Rumoh Geudong Aceh 1989-1998, dan penembakan mahasiswa Trisakti 1998.
Meski terbilang perkara lawas yang terus menerus menjadi warisan, Mahfud menyatakan Presiden Jokowi memastikan untuk mengusut tuntas satu persatu pelanggaran tersebut.
“Harus diungkap dong. Kan sudah diungkap semua kan sudah diungkap. Semua berjalan secara hukum yang belum mari kita selesaikan,” kata Mahfud.
