Diduga Gelapkan Dana Pinjaman Hingga Milyaran Rupiah, Mantan Dirut Bank Ternyata Masih Bebas

MANGUPURA, beritaterkini.co.id | Dugaan kasus korupsi milyaran rupiah di tubuh LPD Sangeh, masih terus bergulir di persidangan Pengadilan Tipikor Denpasar. Rencananya, Selasa 7 Maret 2023, sidak kembali di gelar dengan agenda pemeriksaan saksi.

Dalam kasus tersebut, mantan Kepala LPD Sangeh Nyoman Agus Aryadi telah ditetapkan sekbagai tersangka oleh Kejaksaan Tinggi (Kejati) Bali. Bahkan Agus telah ditahan sejak beberapa waktu lalu. Sementara sejumlah pengurus lainnya yang diduga terlibat masih berstarus saksi.

Meskipun kasus tersebut telah masuk ke persidangan, namun kasus LPD Sangeh masih menyisakan misteri, terkait keberadaan uang Rp 3,5 Milyar. Sampai saat ini keberadaan uang LPD tersebut masih menjadi perdebatan diantara para pengurus dan pemangku kebijakan di LPD Sangeh.

JPU diharapkan mampu menguak misteri tersebut, sehingga tidak hanya mantan Kepala LPD Sangeh yang ditahan karena banyak pihak yang terlibat dalam kasus ini. Hal tersebut berdasarkan fakta persidangan serta majelis Hakim telah memerintahkan JPU untuk memproses semua pihak yang terlibat.

Melalui keterangan tertulisnya, mantan Kepala LPD Sangeh Nyoman Agus Aryadi menyampaikan, bahwa raibnya dana LPD Rp 3,5 Milyar itulah yang menyebabkan LPD kolef dan akhirnya menyeret dirinya ke bui.

“Ada dana LPD yang dipinjam oleh Bank Sangeh. Ini menjadi cikal bakal kolefnya LPD Sangeh,” ujar Agus.

Dijelaskan, pada tahun 2009 PT Bank Desa Sangeh mengalami masalah karena banyaknya kredit macet. Bahkan terancam dilikuidasi oleh Bank Indonesia.

Untuk menyelamatkan Bank Sangeh, kemudian dilakukan paruman dan atas kesepakatan Bendesa Adat Sangeh, Prajuru Desa Sangeh, Komisaris Bank Sangeh serta para pemegang saham, diputaskan Bank Sangeh meminjam dana ke LPD Sangeh.

“Waktu itu disepakati besar pinjaman mncapai tiga setengah milyar rupiah,” jelas Agus.

Lanjutnya, saat itu Direktur Bank Sangeh dijabat oleh Ida Bagus Duniartha. Sehingga pinjaman tersebut atas nama yang bersangkutan bertindak untuk dan atas nama PT Bank Desa Sangeh. Pinjaman tersebut disetujui oleh Bendesa Sangeh yang saat itu dijabat oleh Ida Bagus Dipayana.

“Pinjaman tiga setengah milyar rupiah tersebut dibagi menjadi tujuh pinjaman. Masing-masing pinjaman sebesar lima ratus juta rupiah dan kesemua pinjaman atas nama Ida Bagus Duniartha. Bukti pinjaman lengkap sudah disita oleh JPU,” tuturnya melalui keterangan tertulis.

Dijelaskan pula, setelah pinjaman dicairkan, beberapa kali pihak Bank Sangeh telah membayar bunga pinjaman. Sehingga di tahun 2011, sisa pinjaman Bank Sangeh sebesar Rp 3,4 Milyar.

“Namun untuk selanjutnya, Bank Sangeh tidak mampu lagi membayar pinjaman, baik bunga maupun pokok,” imbuhnya.

Karena Bank Sangeh sudah tidak mampu lagi membayaran pinjamannya, maka pada tanggal 11 Oktober 2011, atas kesepakatan pemegang saham, seluruh saham Bank Sangeh diserahkan ke LPD Sangeh.

Keputusan ini diambil berdasarkan hasil rapat antara pemegang saham, Bendesa Adat Sangeh, Komisaris Bank, Direksi Bank Sangeh, Badan Pengawas LPD dan pengurus LPD.

“Keputusan ini tertuang dalam notulen rapat dan notulen rapat itu sudah disita oleh JPU juga,” terang Agus.

Namun kenyataannya, kesepakatan yang dibuat dalam rapat tidak pernah dilaksanakan oleh pihak Desa Adat. Dalihnya karena dana yang dari LPD tersebut ternyata tidak tercatat di Bank Sangeh.

“Tim audit juga sudah melakukan audit ke Bank Sangeh, ternyata memang benar pinjaman tersebut tidak tercatat dalam neraca Bank Sangeh,” tuturnya.

Dengan demikian, telah terjadi penggelapan dana LPD oleh Ida Bagus Duniartha, yang menjabat sebagai Direktut Bank Sangeh saat itu. Menurut Agus, bukti-buktinya jelas dan sudah ada pada JPU. Namun kenyataannya, yang bersangkutan tidak diproses ataupun ditahan.

Terhadap fakta tersebut, pihaknya sudah menghubungi Gusti Agung Adi Wiputra, Bendesa Adat Sangeh yang saat ini masih menjabat untuk menjelaskan hal yang sebenarnya terjadi.

“Seandainya desa adat mau menindaklanjuti kesepakatan rapat itu, mungkin LPD Sangeh tidak akan bermasalah seperti sekarang ini,” ujarnya.

Namun Bendesa Adat langsung menyatakan tidak pernah ada hutang Bank Sangeh di LPD Sangeh. Perlu diketahui, orang tua Bendesa Adat I Gusti Nyoman Winda, merupakan pemegang saham Bank Sangeh dan ikut menandatangani nota kesepakatan pelimpahan sahan.

“Ganjilnya lagi, Bank Sangeh tidak mengakui hutangnya di LPD Sangeh, tapi nyatanya Bank Sangeh pernah beberapa kali membayar bunga. Kalau memang ngak berhutang, ngapain bayar bunga. Ini kan aneh,” imbuhnya.

Karena itu, pihaknya meminta JPU untuk mengusut kasus ini secara profesional, sehingga orang-orang yang terlibat bisa diproses secara hukum dan harus mempertanggungjawabkan perbuatannya.

“Jangan hanya saya yang dijadikan tumbal dalam kasus ini. Padahal dakwaan Jaksa jelas mengatakan secara bersama-sama. Berarti pelakunya lebih dari satu,” pungkasnya.

Sayangnya Kepala Kejaksaan Tinggi Bali belum bisa dikonfirmasi terkait kasus tersebut.(ded/sdp)
