Denpasar, beritaterkini.co.id – Persoalan Reklamasi PT. Pelabuhan Indonesia (Persero) atau Pelindo Regional Bali Nusra nampaknya akan kembali kelimpungan, kerena belum mengantongi iji dumping, setelah mendapat berbagai sorotan tajam. Setelah Kepala Kantor Wilayah Badan Pertanahan Nasional (Kanwil BPN) Provinsi Bali, Ir. Andry Novijandri membongkar Pelindo belum mengajukan surat hak tanah reklamasi seluas 132,9 hektar, kini pengajuan ijin lokasi dumping baru untuk pembuangan material atau limbah ke tengah laut juga masih terganjal. Perlu diketahui, luas reklamasi pengembangan Pelabuhan Benoa di Dumping 1 seluas 25 hektar, sedangkan HPL (Hak Penglolaan Lahan) 1 seluas 41 hektar, HPL 21 seluas 7 hektar, HPL 22 seluas 12 hektar, dan Dumping 2 seluas 45 hektar. Bahkan hingga kini konsesi yang dijanjikan Pelindo untuk Pemprov Bali dan Pemkot Denpasar di area Dumping 1 dan Dumping 2, dikabarkan belum juga bisa diterbitkan HPL-nya.
Ketika dikonfirmasi, Kepala Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu (Kadis DPMPTSP) Provinsi Bali, Anak Agung Ngurah Oka Sutha Diana belum bisa menjawab dengan pasti terkait pengajuan ijin lokasi dumpung baru untuk pembuangan material ke tengah laut di kawasan Pelabuhan Benoa. “Baiknya ke LH (Kadis Lingkungan Hidup dan Kehutanan, red) nggih. Prosesnya teknis di LH,” terangnya singkat, saat dihubungi para awak media, Senin (19/6/2023). Namun sayangnya secara terpisah, Kadis Kepala Dinas Kehutanan dan Lingkungan Hidup Provinsi Bali, I Made Teja juga terkesan masih tertutup berkaitan dengan kabar tersebut. Bahkan, anehnya ia mengaku sampai saat ini belum menerima surat resmi apapun mengenai pengajuan ijin lokasi dumping tersebut. “Saya belum dapat surat resmi nanti cek lagi mungkin OPD lain yang menangani,” bebernya.
Di tempat terpisah, Kelompok Ahli Bidang Infrastruktur Pemerintah Provinsi Bali, Ir. Made Arca Eriawan mengakui adanya permohonan lokasi dumping untuk membuang hasil dredging atau pengerukan alur di Pelabuhan Benoa. “Yang saya tahu bukan dumping untuk perluasan area, tapi mohon lokasi dumping untuk membuang material hasil kerukan untuk pendalaman alur di Pelabuhan Benoa,” ujarnya, seraya membenarkan hasil kerukan material itu, akan dibuang ke tengah laut. “Ini untuk buang di tengah laut, masalahnya dalam RZWP3K Provinsi Bali tidak punya zona dumping,” katanya, sembari menegaskan lokasi baru untuk pembuangan material tersebut tidak diperuntukan untuk rencana reklamasi, seperti halnya di area Dumping 1 dan 2 Pelabuhan Benoa. “Untuk hal ini tidak (reklamasi, red), nyari tempat untuk buang,” tandasnya.
Pihaknya juga mengungkap sampai sekarang pengajuan lokasi dumping itu, belum bisa disetujui Pemprov Bali. Meskipun tidak butuh kajian, namun lokasi dumping tersebut, juga menjadi salah satu kewenangan Provinsi Bali. “Sementara belum ada ijinnya. Tapi kan harus carikan jalan keluar. Karena 0-12 mil ke arah laut adalah wilayah kewenangan provinsi, di luar itu kewenangan nasional. Belum (ijin lokasi dumping, red) akan dibahas dulu jalan keluarnya. Ini kan juga merupakan Proyek Strategis Nasional,” bebernya, sekaligus kembali menjelaskan dumping pembuangan material ini, tidak boleh lagi dipakai sebagai perluasan lahan reklamasi ke depan. “Ya alternatif dumping kan ada banyak, bisa di darat (sekalian untuk nguruk), di laut (sekalian untuk perluasan daratan/reklamasi) dan ya dibuang. Kan tidak semua material yang ada juga bagus untuk urukan, banyak liumpur dan lain-lain,” pungkasnya.
Perlu diketahui, rencana untuk pengajuan dumping pembuangan material atau limbah oleh Pelindo, juga wajib memenuhi ketentuan Pasal 449 huruf a sampai huruf q Peraturan Pemerintah Nomor 22 Tahun 2021 tentang Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup serta untuk mengintegrasikan persetujuan teknis dan/atau surat kelayakan operasional pengelolaan limbah bahan berbahaya dan beracun ke dalam pesertujuan lingkungan maka telah dibentuk Peraturan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia Nomor 6 Tahun 2021 tentang Tata Cara dan Persyaratan Pengelolaan Limbah Bahan Berbahaya dan Beracun. Pada Permen LHK ini salah satu ketentuan yang diatur yaitu mengenai Dumping atau pembuangan Limbah yang diatur selanjutnya pada BAB X. Bagi setiap orang yang melakukan Dumping limbah ke laut, maka diwajibkan memiliki persetujuan dari Pemerintah Pusat.
Namun tidak semua limbah dapat dilakukan pembuangan ke laut, berdasarkan Pasal 198 Permen LHK ini. Selain itu, juga ada ijin dumping ke laut yang dipersyaratkan oleh Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu, di antaranya wajib menyertakan IMB, Ijin Lokasi/ Ijin Prinsip, dan Persetujuan Dokumen Izin Lingkungan (UKL/UPL)/ AMDAL). Persoalannya hingga kini HPL untuk lahan Damping 1 dan 2 di Pelabuhan Benoa dikabarkan belum juga bisa diterbitkan, sehingga mengganjal turunnya AMDAL untuk perubahan pengembangan Pelabuhan Benoa. Sebelumnya, juga terungkap lahan reklamasi Dumping 1 yang diklaim sebagai wilayah Desa Adat Kepaon disebut-sebut warga tidak ada sosialisasi apalagi memberi tanda tangan persetujuan terhadap AMDAL sebagai dasar Pelindo melakukan reklamasi sebelumnya. Tokoh Masyarakat Kepaon I Ketut Jana S.Pd.H., membaca kondisi yang mana Reklamasi Teluk Benoa dilakukan Pelindo, khususnya Dumping 1 yang sekarang sedang proses pembangunan fisik tentunya ijin AMDAL-nya patut diduga abu-abu, mestinya segera ditetapkan sebagai Wilayah Kepaon.
“Wilayah kami jangan dijadikan obyek proyek saja dengan dalih pusat dan pengembangan wisata Bali namun mengabaikan hak kami sebagai warga terdampak langsung,” ungkapnya kepada wartawan. Mantan Kepala Dusun (Kadus) Banjar Adat Sakah Kepaon Denpasar ini menyebutkan, persoalan reklamasi Dumping 1 yang masuk wilayah milik Kepaon sudah lama bermasalah. Namun dikatakan justru pihak Pelindo III terkesan mengabaikan. Bahkan dikatakan sudah ada hasil rapat koordinasi yang dilakukan di Kantor Camat Denpasar Selatan tapi tidak ditindaklanjuti sampai sekarang. “Dulu saat masih konstruksi sempat ribut. Dan telah dilakukan beberapa kali rapat koordinasi di Kantor Camat Denpasar Selatan melibatkan stakeholder pemegang kebijakan namun hasilnya juga terkesan diabaikan,” ungkap Ketut Jana. “Jangan hanya saat membangun Fasilitas Umum Pendukung seperti IPAL DSDP dan Reboisasi Mangrove kami sebagai masyarakat pribumi diberi angin surga. Akan tetapi, saat reklamasi Dumping 1 Pelindo yang jelas di Barat Loloan Prapat Nunggal masuk wilayah Kepaon kami dilupakan,” keluhnya.
Untuk diketahui sebelumnya, sebagai perusahaan plat merah PT. Pelindo dinyatakan ATR/BPN Denpasar belum pernah mengajukan pengukuran lahan reklamasi. Artinya, disinyalir tidak memiliki alas hak berupa sertifikat hak guna bangunan (HGB). Dan patut diduga juga pembangunan dilakukan sekarang ini belum mengantongi izin mendirikan bangunan (IMB) atau persetujuan bangunan gedung (PBG). “Terkait permohonan, kami sarankan untuk tanyakan langsung ke Pelindo, karena sampai saat ini Pelindo belum pernah mengajukan permohonan ke kami (ATR/BPN Kota Denpasar, red) makanya kami tidak tau persis. Jadi saran kami silahkan koordinasi dengan Pelindo karena mereka yang punya proyek,” ungkap Ida Ayu Ambarwati selaku Kasubag TU ATR/BPN Kota Denpasar kepada wartawan di Denpasar Bali, Selasa (2/8/2022). Ida Ayu Ambarwati menegaskan, terkait batas-batas lahan reklamasi di Teluk Benoa dan juga luasan dikatakan pihak ATR/BPN Denpasar tidak tahu menahu soal itu, baik batas-batasnya karena belum ada laporannya ke ATR/BPN Denpasar.
“Terkait dengan masalah batas obyek wilayah yang menjadi pertanyaan ke kami tentang tanah reklamasi Pelindo, dari kami di BPN mempersilahkan melakukan konfirmasi ke pemerintah Kota Denpasar, karena Pelindo masuk wilayah hukum Kota Denpasar sehingga jika ada permohonan sertifikasi obyek nanti kalau sudah sertifikasi tentu masuk di Kota Denpasar. Apalagi hingga saat ini kami di BPN belum tahu menahu soal itu, baik batas-batasnya karena juga belum ada laporannya ke BPN,” pungkas Ida Ayu Ambarwati. Sementara itu Departement Head Hukum dan Humas Pelindo Regional 3 Karlinda Sari mengatakan, dalam upaya pengembangan Bali Maritime Tourism Hub (BMTH) di area eksisting pelabuhan, Pelindo telah mengantongi surat ijin mendirikan bangunan atau IMB dari pemerintah setempat dalam hal ini adalah pemerintah Kota Denpasar melalui Dinas PUPR setempat.
“Di dalam area eksisting Pelabuhan Benoa kita lakukan pembangunan infrastruktur penunjang BMTH seperti UMKM Mart, dan hal ini sudah kami koordinasikan dengan pemerintah setempat agar sesuai dengan tata ruang daerah, selain itu kami juga sudah mendapatkan surat Ijin Mendirikan Bangunan atau IMB”, jelas Karlinda. Sementara itu dalam hal pengembangan area pengembangan 1 dan 2, Pelindo juga sudah melakukan koordinasi, memperoleh perizinan dan mendapatkan dukungan dari beberapa pihak seperti Kementerian Perhubungan, BUMN, KLHK, ATR dan KKP. Pelindo juga menggandeng Aparat Penegak Hukum setempat dan Nasional, salah satunya Kejaksaan Agung RI untuk turut mendampingi dan mengawasi pekerjaan proyek tersebut mengingat pengembangan BMTH merupakan salah satu proyek strategis nasional, yang juga dimanfaatkan untuk menunjang kegiatan G20 di Bali sehingga harus disukseskan bersama.
“Untuk pengurusan hak atas tanah di area pengembangan 1 dan 2, kami terus melakukan koordinasi dengan berbagai pihak terkait, dimana hak atas tanah tersebut akan dilakukan pengurusan HPL oleh Kementerian Perhubungan ke BPN terlebih dahulu, yang kemudian nantinya Pelindo akan memohonkan hak atas tanah diatas HPL Kementerian Perhubungan tersebut”, pungkas Karlinda. Sama seperti sebelumnya, saat dikonfirmasi terkait nomor IMB, alas hak dan status lahan reklamasi apakah HGB atau sertifikat hak milik hingga berita ini ditayangkan pihak Pelindo belum memberikan jawaban. 021/002
