Ahli Depkumham di Sidang PN Denpasar Tegaskan Ada Pemalsuan Merek Dagang Milik Janda Beranak Dua
DENPASAR, beritaterkini.co.id | Polda Bali menghadirkan ahli hukum pidana merek dari Departemen Hukum dan HAM untuk menangkis dalil pemohon praperadilan merek dagang makanan ringan milik janda beranak dua yang diduga digasak oleh istri seorang pejabat di pengadilan.
Kehadiran ahli yang dihadirkan Polda Bali tersebut untuk menjelaskan kepada hakim Pengadilan Negeri (PN) Denpasar yang menyidangkan kasus praperadilan merek dagang pada sidang yang digelar pada Jumat 16 Juni 2023.
Ahli yang dihadirkan Polda Bali tersebut adalah Agustiawan Muhammad, S.H., M.H. yang juga diminta pendapatnya oleh penyidik Polda Bali saat proses penyidikan. Ahli Agustiawan Muhammad menegaskan penetapan dua tersangka dugaan pemalsuan merek Ny. OH dan TAC sudah mememuhi syarat dan ketentuan berlaku.
Dalam sidang tersebut baik hakim tunggal I. G.N.A Aryanta Era dan kuasa hukum pemohon praperadilan menanyakan pengertian merek, persamaan pada pokoknya dan persamaan dari keseluruhan atas dugaan pemalsuan merek dengan tersangka.
Kredibilitas ahli juga tidak diragukan karena sebelumnya ahli pernah memberi kesakasian di PN Jakarta Barat jadi ahli hukum pidana pemalsuan merek.
Inti keterangan ahli, setelah membuka UU No 20 tahun 2016 Tentang Merek Dan Indikasi Geografis pasat 100 ayat 2, merek yang diajukan tersangka TAC dan Ny. OH ada kemiripan dan persamaan pada pokoknya. Dengan demikian patut diduga tindak pemalsuan merek yang dilakukan dengan jenis barang dan jasa.
Dari pemeriksaan ahli, ditunjukan barang bukti tersangka dan pelapor, melihat merek tersangka ada terdapat pada milik orang lain yang sudah terdaftar.
“Saya sampaikan keterangan dengan sebenarnya dengan pengetahuan saya,” tandas ahli.
Sesuai ketentuan, perlindungan terhadap merek diberikan sebagaimana pasal 3, sejak surat keterangan terbit dan dapat diperpanjang dalam waktu 10 tahun atau jangka waktu habis.
Perlindungan suatu merek terdaftar mendapat pelindungan hukum untuk jangka waktu 10 tahun sejak tanggal penerimaan dan dapat diperpanjang untuk jangka waktu yang sama.
Untuk mendapat perlindungan hukum, secara formalitas selama satu bulan sejak terbit sertifikat merek dari Kemenkum HAM, jika sudah terpenuhi dua bulan dipublikasikan akan mendapat perlindungan dari negera.
Disinggung pidana merek, kata Agustiawan Muhammad, setiap orang yang dengan tanpa hak menggunakan merek yang mempunyai persamaan pada pokoknya dengan merek terdaftar milik pihak lain untuk barang dan jasa.
Jadi, bisa dikenakan pada setiap orang yang memperdagangkan produksi dengan kesamaan kemiripan merek yang sudah terdaftar sebelumnya.
“Tersangka produksi belum mendapat sertifikat merek terdaftar. Jadi tidak ada perlindungan hukum sebelum terbitnya sertifkat merek,” katanya menegaskan.
Dengan kata lain, Ahli berpandangan, acuannya karena adanya persamaan pada pokoknya sebagai ketentuan tentang pendaftaran merek.
Dijelaskan, persamaan ada pokoknya yakni ada kemiripan bentuk tulisan, warna dari dua barang tersebut yang kemudian dijadikan barang bukti.
Persamaan pada pokoknya, ada kemiripan persamaan kata bunyi bentuk kombinasi dari kedua atau lebih, kata tersebut sehingga ada kemiripan.
Kemiripan itu dimaksud baik dalam bentuk tulisan, segi bunyi dari kata pada barang jasa yang sama.
Dari bukti yang diajukan kesamaan merek, sebelum sertifikat merek diperoleh mendapat perlindungan hukum adalah yang lebih dahulu terdaftar. “Sertifat hanya berfokus pada merek atau contoh label yang dominan,” katanya.
Lebin lanjut ahli berpandangan dalam merek barang dan jasa ada klasifikasi barang, semua diakui UU merek 46 kelas untuk baranf 1-34, dan 35-40 untuk jenis jasa.
Ahli berpandangan, merek jasa dan barang bisa dilihat pada tanda yang berbeda nama, huruf, atau susunan warna, bisa dimensi suara atau hologram yang diajukan permohonan
atau saat melakukan perdagangan barang dan jasa.
Kuasa Hukum termohon Polda Bali AKBP Imam Ismail menyatakan harapannya setelah keterangan ahli akan disampaikan dalam kesimpulan pada sidang Senin mendatang.
Imam memastikan bahwa sebelum menetapkan tersangka pihaknya telah mendapatkan dua alat bukti, termasuk keterangan ahli dan juga bukti lainnya. “Kita ada alat bukti lain juga, memperkuat sangkaan dugaan pemalsuan merek bahwa kedua tersangka menggunakan merek yang sudah terdaftar milik orang lain,” katanya.
Seperti diketahui TAC mengajukan praperadilan dengan termohon Kapolda Bali tentang sah atau tidak penetapan Tersangka dalam Laporan Polisi Nomor: LP/B/92/II/2023/SPKT/POLDA BALI tanggal 14 Februari 2023 tentang tindak pidana Merek dan Indikasi Geografis yaitu dengan tanpa hak menggunakan merek yang mempunyai persamaan pada pokoknya dengan merek terdaftar milik pihak lain.
Pelapor sendiri adalah Teni Hargono yang merupakan janda beranak dua, sementara suaminya telah meninggal dunia beberapa tahun lalu. Dia mempertahankan merek dagang Fettucheese yang ia punya, merek dagang itu merupakan merek makanan ringan yang dia rintis sejak awal.
Teni mendaftarkannya ke Kemenkum HAM untuk mendapatkan pengakuan dan setelah bersusah payah malah dipakai orang lain yakni TAC dan Ny. OH yang merupakan istri hakim yang belakangan dia adalah Ketua PN Parigi Sulawesi Tengah, tentu saja ini menjadikan kerugian. Karena itu adalah menjadi sumber penghasilan untuk menghidupi keluarga dan kedua anaknya. (Red)

I know this if off topic but I’m looking into starting my own blog and was wondering what all is required to get set up? I’m assuming having a blog like yours would cost a pretty penny?
