JAKARTA.Beritaterkini.co.id. Ketua Umum Badan Peneliti Independen Kekayaan Penyelenggara Negara & Pengawas Anggaran RI. Tubagus Rahmad Sukendar S.Sos.SH meminta Komisi Pemberantasan Korupsi (KPK) & Jaksa Agung mengawasi persidangan perselisihan korp Amerika Get All 40 dengan perusahaan Get all 40 lokal, tentang dakwaan yang sudah sampai ke mahkamah agung.

Dan putusan akhir itu, mereka menang di Komisi Banding HKI yang membuat Get all 40 berhasil merebut kembali haknya karena terhentinya produksi Purchase Order (PO) yang mereka kirimkan.

Selain itu, setelah berhasil memperoleh kembali haknya dari putusan Pengadilan Niaga Jakarta Pusat terkait gugatan ganti rugi yang tercatat dalam gugatan nomor 41, BPI KPNPA RI akan mengurus perkara ini hingga memiliki kekuatan hukum permanen.

Ketua Koperasi Pasar HWI Lindeteves Chandra Suwono berharap adanya perhatian serta dukungan dari Komisi III DPR RI terkait perseteruan merek dagang cairan anti karat buatan anak bangsa Get All 40 dengan produk asal Amerika WD 40.

Hingga saat ini, kasus tersebut belum menemui titik terang dan pada akhirnya bisa mematikan bisnis Get All 40 milik Benny Bong itu.

“Bagaimana produk inovasi dari putra bangsa itu bisa dimatikan oleh barang impor? Nah ini yang kita tidak mau terjadi. Maka itu akan lebih baik jika Komisi III membantu putra bangsa supaya yang terkait dalam kasus ini bisa dipanggil untuk klarifikasi, misalnya Kemekumham, HKI, Get All 40 dan WD 40 untuk menyelesaikan masalah ini. Karena jika melalui pengadilan, akan memakan waktu yang lama sekali,” kata Chandra saat ditemui di kantornya di bilangan Taman Sari, Jakarta Barat.

Seperti diketahui, Benny Bong selaku pemilik Get All 40 adalah pengusaha lokal sekaligus anggota koperasi yang dia pimpin.

“Sebagai ketua koperasi dan juga seorang pengusaha, saya memberikan apresiasi keputusan HKI yang mengabulkan gugatan Get All-40 dan menerbitkan kembali sertifikat baru,” jelasnya.

Ia bercerita, Get All-40 awalnya sudah memiliki hak paten sejak 2008. Tiga tahun kemudian, WD 40 baru mendaftarkan hak patennya dalam empat kategori.

“Setelah mendapatkan hak paten tersebut, pihak WD 40 malah menggugat Get All-40. Akhirnya tahun 2015 WD 40 menang gugatan sehingga sertifikat HKI Get All 40 dicabut. Proses hukumnya alot hingga sampai Mahkamah Agung,” terang Chandra.

Tahun 2019, Get All 40 mendapat peluang untuk bisa menggunakan kembali merek dagangnya melalui Perpres No. 90 thn 2019 tentang tata cara Banding Merek di HKI. “Kesempatan itu dimanfaatkan Get All-40 sampai akhirnya menang Banding. Kemudian Get All-40 minta ganti rugi kepada WD 40,” papar Chandra.

Proses selanjutnya, Get All-40 mengajukan gugatan pada Agustus 2020. Namun gugatan baru disidangkan pada 6 Januari 2021, dengan alasan WD 40 perusahaan asing sehingga harus menunggu 3 bulan untuk melengkapi dokumen.

Kemudian pada sidang tanggal 6 Januari, pihak WD 40 tidak hadir. Beberapa hari kemudian muncul gugatan balik yang meminta Pengadilan Negeri Niaga Jakarta Pusat mencabut sertifikat HKI Get All 40. Sidangnya digelar pada Rabu 17 Februari lalu.

“Dalam gugatannya, pengacara WD 40 ternyata tidak mempunyai legal standing sehingga ditolak hakim,” tandasnya.

Menurut Chandra, pihak WD 40 melakukan gugatan balik untuk mencabut sertifikat Get All 40 seperti yang mereka lakukan di tahun 2015. “Di sini saya melihat tidak adanya itikad baik dari WD 40.

Karena dengan dia menggugat kembali Get All 40, artinya kasus ini menjadi rancu karena pada satu objek dengan para pihak yang sama, tapi ada dua gugatan. Ini menyalahi mencederai hukum Indonesia, ini juga mencederai asas peradilan Indonesia yang sederhana, cepat dan murah,” ungkapnya.

Maka dari itu, Chandra menyarankan agar kedua belah pihak duduk bersama untuk membicarakan solusi terbaik. Ia juga berharap Pemerintah dapat memberikan kepastian hukum kepada Get All 40 dan produk lokal lainnya.

“Harusnya pemerintah memberi dukungan berupa kepastian hukum dan ruang berinovasi bagi produk-produk lokal. Tidak hanya kepada Get All 40, tetapi juga pada produk-produk lainnya. Sehingga produk-produk lokal memiliki daya saing di dalam negeri dan dunia internasional,” harapnya.

Chandra juga mengingatkan, sebaiknya perseteruannya tidak perlu dilanjutkan karena ini akan merugikan para pihak.

“Kita mau bisnis, kita mau dagang. Jadi mungkin solusi terbaik adalah bersama-sama kooperatif. Karena sampai saat ini saya lihat pihak WD 40 itu kurang kooperatif. Sebagai bukti mereka kurang kooperatif adalah gugatan Get All 40 itu bukannya dijawab, tetapi malah membuat gugatan baru,” paparnya.
