JAKARTA – BERITATERKINI.co.id – Ratusan massa yang mengatasnamakan Himpunan Aktivis Milenial (HAM) Indonesia melakukan aksi demonstrasi di depan gedung Kejaksaan Agung (Kejagung) pada Minggu siang, (29/12/2019).
Mereka meminta agar penyidik Komisi Pemberantasan Korupsi (KPK), Novel Baswedan segera ditangkap dan diadili dalam kasus penganiayaan yang mengakibatkan terduga pencuri sarang burung walet di Bengkulu tahun 2004 silam meninggal dunia.
Pantauan Beritaterkini.co.id di lapangan, mereka juga membawa poster bertuliskan, ‘Tangkap dan Penjarakan Novel baswedan,’ ‘Novel Baswedan Bukan Malaikat, Tak Boleh Kebal Hukum,’ dan ‘Novel Baswedan Harus Mendekam di Penjara.’ Massa juga terlihat membakar ban bekas di depan pintu masuk Kejagung seraya mengibarkan bendera merah putih.
Koordinator Aksi, Moh Hafidz Kudsi meminta Kejagung tidak boleh main-main dalam penegakan hukum. Siapapun yang bersalah kata dia, harus diproses hukum termasuk Novel Baswedan.
“Novel Baswedan sang pembunuh harus segera ditangkap dan diadili. Tidak boleh ada yang kebal hukum,” kata dia dalam orasinya di hadapan massa aksi.
Dia menyesalkan karena Kejagung telah menghambat proses peradilan kepada Novel Baswedan, yang sudah terbukti melakukan penganiayaan dan pembunuhan berdasarkan hasil penyelidikan dan penyidikan yang dilakukan aparat kepolisian.
“Tapi sudah 15 tahun berlalu, perkara Novel Baswedan menguap begitu saja. Atau ini bagian dari pembenaran bahwa penegakan hukum di Indonesia hanya ‘tajam ke bawah, tapi tumpul ke atas’. Ingat, Kejagung tidak boleh melindungi pembunuh,” tegas Hafidz.
“Demi keadilan, tangkap dan jebloskan Novel Baswedan ke dalam penjara,” imbuh dia.
Hafidz curiga ada kongkalikong antara KPK dan Kejagung, sehingga sampai saat ini perkara Novel Baswedan belum juga sudah masuk Pengadilan. Jika dugaan dirinya benar, Hafidz mengaku bahwa hal itu merupakan ancaman serius bagi penegakan hukum ke depan.
“Negara haram hukumnya melindungi penganiaya dan pembunuh. Kejagung wajib segera limpahkan berkas perkara Novel Baswedan ke Pengadilan. Kejagung jangan jadi pengecut,” kata Hafidz.
Hafidz berjanji akan membawa massa dalam jumlah yang lebih besar jika tuntutannya tidak direspon Kejagung.
Untuk diketahui, berdasarkan hasil penyidikan yang dilakukan aparat kepolisian dan pemeriksaan terhadap sejumlah saksi serta barang bukti, rekonstruksi pemeriksaan tempat, adegan terjadinya penembakan dikaki para korban, berkas perkara Novel Baswedan kemudian dianggap lengkap sebagaimana Pasal 138 KUHAP, sehingga berkas perkara dilimpahkan ke Kejaksaan.
Kejaksaan juga menyatakan berkas Novel sudah P21 setelah melakukan pemeriksaan secara rigit dan komprehensif. Kemudian Kejaksaan melimpahkan berkas perkara ke Pengadilan Negeri (PN) Bengkulu pada 29 Januari 2016 lalu, agar Novel segera disidangkan.
Tapi JPU menarik kembali surat tuntutan pada tanggal 2 Februari 2016 dengan dalih mau disempurnakan. Namun, Kejaksaan tiba-tiba mengeluarkan Surat Ketetapan Penghentian Penuntutan (SKPP) Nomor B-03/N.7.10/Ep.1/02/2016 yang ditandatangani Kepala Kejaksaan Negeri Bengkulu.
Tak terima, korban kemudian mengajukan gugatan Praperadilan ke PN Bengkulu. Putusan Praperadilan kemudian mencabut SKPP Kejaksaan karena dianggap tidak memiliki dasar hukum kuat.
PN Bengkulu juga memerintahkan Kejaksaan segera melimpahkan berkas perkara Novel Baswedan ke Pengadilan agar segera disidangkan.
